Within the current lot coverage limitations, which have a rational basis in <br />providing additional buffer or separation between intensive land uses and abutting <br />properties, the applicant is still able to put the property to a number of reasonable uses, <br /> <br />2, There is insufficient unique circumstances present to warrant a variance for the proposed <br />use. <br /> <br />3. As submitted and as subsequently modified by the applicant, and in spite of the recently <br />adopted design and performance standards for uses within the Shopping Center Districts, <br />the proposed expanded use would negatively affect the character of the neighborhood due <br />to the proximity of the development to the residential properties abutting the subject <br />parcel; the intensity of the proposed use and orientation of the expansion toward the <br />residential neighborhood; and the traffic generated by the proposed expansion. <br /> <br />NOW THEREFORE BE IT FURTHER RESOLVED by the City Council of the <br />City of Roseville, Minnesota, that the application to issue a Variance to allow the construction of <br />an additional 18,508 square feet of grocery retail, enclosed delivery, and enclosed trash area at the <br />Har Mar Mall is hereby denied. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member , and upon vote being taken thereon the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />WHEREUPON said resolution was declared duly passed and adopted on the 10th day of <br />April, 2000. <br />
