REQUEST FOR COUNCIL ACTION <br /> Date: October 6, 2014 <br /> Item No.: 7.d <br />Department Approval City Manager Approval <br />Item Description: Request by the Community Development Department for Authorization to <br />Enter into a Joint Powers Agreement with the St. Paul Port Authority to <br />Administer the Property Assessed Clean Energy Program (PACE of MN) <br />B <br />ACKGROUND <br />1 <br />At the September 15, 2014 work session, the St. Paul Port Authority made a presentation about <br />2 <br />how it is working with cities across the state to promote clean energy programs and the <br />3 <br />specialized nature of its expertise. <br />4 <br />The Community Development Department brought this issue forward to the City Council in <br />5 <br />preparation for an anticipated request from St. Christopher’s Church to use the PACE program to <br />6 <br />fund a solar system on its property. St. Christophers had previously been in contact with St. Paul <br />7 <br />Port Authority regarding its financing needs. <br />8 <br />As indicated in the September 15, 2014 meeting, the City and the Port Authority have the power <br />9 <br />to amend or break the agreement at any time (although any existing loans or bonds would still be <br />10 <br />subject to the agreement in place at the time of their execution). <br />11 <br />The City Council directed staff to negotiate a draft agreement for consideration. The City <br />12 <br />Attorney has reviewed and approved the joint powers agreement, which is included as <br />13 <br />Attachment A. <br />14 <br />PO <br />OLICYBJECTIVE <br />15 <br />This action will promote the City Council’s clean energy and economic development goals by <br />16 <br />allowing private, non-profit and religious institutions to have access to the array of clean energy <br />17 <br />and energy efficiency programs that it administers. These programs will provide financing <br />18 <br />options that may have significantly more favorable terms than what is currently available to these <br />19 <br />groups using traditional financing sources. <br />20 <br />The action also represents a form of intergovernmental cooperation which will be more efficient <br />21 <br />than trying to create a similar program with Roseville staff. <br />22 <br />BI <br />UDGET MPLICATIONS <br />23 <br />The St. Paul Port Authority is compensated by the applicants as part of the loan process and is <br />24 <br />not paid for its services by the City of Roseville. <br />25 <br />There will be a small increase in staff time necessary to prepare RCAs for approving the <br />26 <br />applications and transferring the assessment payments to the St. Paul Port Authority. It is <br />27 <br />anticipated that these will turn into short “boilerplate” RCAs, minimizing staff impacts. <br />28 <br />Page 1 of 2 <br />
