REQUEST FOR COUNCIL ACTION <br /> Date: October 6, 2014 <br /> Item No.: 7.e <br />Department Approval City Manager Approval <br />Item Description: Approve Resolution Approving the Vacation of a Portion of a Drainage <br />and Utility Easement Located at 197 County Road B2 <br />B <br />ACKGROUND <br />1 <br />This item was presented to Council at their September 22, 2014 meeting, at which time a public <br />2 <br />hearing was conducted to accept public comment on the proposed easement vacation. However, <br />3 <br />th <br />because this item required a 4/5’s Council approval and only three Councilmembers were present at <br />4 <br />th <br />the September 22 meeting, the item was tabled to the October 6 Council meeting. <br />5 <br />During the public hearing there were no public comments or testimony received on this item. Staff <br />6 <br />also did not receive any public comment outside of the public hearing leading up to the September 22 <br />7 <br />th <br />meeting or the October 6 meeting. <br />8 <br />In 1981 several drainage and utility easements were granted to the City of Roseville as part of <br />9 <br />the filing of the TRANSIT 2ND ADDITION plat. The bulk of the drainage and utility <br />10 <br />easements were established over an existing wetland and also, it appears, to provide for overland <br />11 <br />drainage from County Road B2 to the wetland. <br />12 <br />Recently the property owner at 197 County Road B2, which is Lot 2, Block 2, of the <br />13 <br />aforementioned plat, has approached the City with the desire to develop the property. However, <br />14 <br />in order to maintain the required wetland setback and still provide enough of a footprint for the <br />15 <br />proposed use, the property owner has asked that the City reduce the width of the existing <br />16 <br />drainage and utility easement along the west side of Lot 2, Block 2. The existing width of the <br />17 <br />easement is 25 feet. <br />18 <br />Staff has worked with the property owner to establish a storm water conveyance system <br />19 <br />consisting of underground pipe to convey water to the rear of the lot that was traveling overland. <br />20 <br />This pipe would be constructed by, and at the cost of, the property owner. If a pipe is used, then <br />21 <br />the drainage and utility easement necessary to support that pipe would only be 10 feet. <br />22 <br />Attached is a Surveyors Certificate depicting the proposed vacation of a portion of the drainage <br />23 <br />and utility easement. <br />24 <br />The vacation will not be official until such time the City Manager executes and records a Notice <br />25 <br />of Completion of this vacation. This will be done once a final design of the storm water <br />26 <br />conveyance system has been approved by the City Engineer and any required agreements for the <br />27 <br />construction of said system have been entered into. <br />28 <br />Therefore, staff is recommending the vacation of 15 feet of the existing 25 foot drainage and <br />29 <br />utility easement. <br />30 <br />Page 1 of 2 <br />
