2 <br />WHEREAS, the Roseville City Council has determined that the vacation would be in the public <br />1 <br />interest; <br />2 <br />3 <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />4 <br />ROSEVILLE, MINNESOTA: <br />5 <br />6 <br />1.That the City of Roseville hereby vacates that portion of the drainage and utility easement <br />7 <br />dedicated to the City by the plat of TRANSIT 2ND ADDITION which lies within the <br />8 <br />following described real property: <br />9 <br />10 <br />That part of Lot 2, Block 2, TRANSIT 2ND ADDITION, according to the <br />11 <br />recorded plat thereof, Ramsey County, Minnesota being described as follows: <br />12 <br />13 <br />the East 15 feet of the West 25 feet thereof which lies North of the <br />14 <br />South 10 feet of said Lot 2 and which lies Southerly of a line <br />15 <br />drawn from a point on the west line of said Lot 2 distant 136.00 <br />16 <br />feet North from the southwest corner thereof to a point on the east <br />17 <br />line of said Lot 2 distant 205.00 feet North of the southeast corner <br />18 <br />thereof. <br />19 <br />20 <br />2.The vacation applies only to the drainage and utility easement which lie within the real <br />21 <br />property described in Provision 1 above which were dedicated to the City by the plat of <br />22 <br />TRANSIT 2ND ADDITION and not to: (a) the rights of existing utilities, if any, and (b) any <br />23 <br />other easements running to or benefiting the City of Roseville. <br />24 <br />3.The vacation is contingent upon the City Engineer’s review and approval of a storm water <br />25 <br />system to mitigate the loss of the existing overland flow of water within the existing <br />26 <br />drainage and utility easement. <br />27 <br />4.The City Manager is directed to execute and record a Notice of Completion of this vacation <br />28 <br />proceeding pursuant to Minnesota Statutes §412.851 once the contingency listed in item 3 <br />29 <br />above. The vacation authorized by this Resolution shall not be effective until the Notice of <br />30 <br />Completion is recorded in the office of the Ramsey County Recorder. <br />31 <br />32 <br />The motion was duly seconded by Councilmember and upon vote being taken thereon, the <br />33 <br />following voted in favor thereof: ; and and the following voted against: <br />34 <br />35 <br />WHEREUPON said resolution was declared duly passed and adopted. <br />36 <br />
