2 <br />1 <br />1.That the City of Roseville hereby vacates that portion of the drainage and utility easement <br />2 <br />dedicated to the City by the plat of O’NEIL’S ADDITION which lie within the following <br />3 <br />described real property: <br />4 <br />5 <br />That part of Lots 18, 19, 20, and 21, Block 1, O’NEIL’S ADDITION, according <br />6 <br />to the recorded plat thereof, Ramsey County, Minnesota being described as <br />7 <br />follows: <br />8 <br />9 <br />the North 6 feet of the entire width of Lots 18, 19, 20 and 21 <br />10 <br />11 <br />2.The vacation applies only to the drainage and utility easements which lies within the real <br />12 <br />property described in Provision 1 above which were dedicated to the City by the plat of <br />13 <br />O’NEIL’S ADDITION and not to: (a) the rights of existing utilities, if any, and (b) any <br />14 <br />other easements running to or benefiting the City of Roseville or the Metropolitan Council. <br />15 <br />3.Contingent upon the establishment of new drainage and utility easements platted on this <br />16 <br />property, the City Manager is directed to execute and record a Notice of Completion of this <br />17 <br />vacation proceeding pursuant to Minnesota Statutes §412.851. The vacation authorized by <br />18 <br />this Resolution shall not be effective until the Notice of Completion is recorded in the office <br />19 <br />of the Ramsey County Recorder. <br />20 <br />21 <br />The motion was duly seconded by Councilmember and upon vote being taken thereon, the <br />22 <br />following voted in favor thereof: ; and and the following voted against: <br />23 <br />24 <br />WHEREUPON said resolution was declared duly passed and adopted. <br />25 <br />
