<br />CD <br /> <br />City or Roseville <br />Planned Unit Development Agreement #1256 <br /> <br />AGREEMENT, approved by the Roseville City Council December 17, 2001 and into entered <br />between the City of Roseville, a Minnesota municipal corporation (herein referred to as "CITY"), <br />and 5005 Properties, Inc., d/b/a Roseville Estates MHP Company Incorporated, a Minnesota <br />Corporation (herein referred to as "DEVELOPER"). <br /> <br />t.O Effective Date of Agreement <br /> <br />This agreement shall be effective upon completion of the following: I) passage and publication of <br />Ordinance # 1256 (Rezoning of Property to PUD); 2) publication of the ordinance in the CITY's <br />otTicial newspaper; 3) execution of this agreement by the CITY and the DEVELOPER; and 4) <br />recording of this agreement with Ramsey County. <br /> <br />2.0 Request for Planned Unit Development and Plat Approval <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development (PUD) <br />(PF#3225) consisting of approval of zoning amendment fTom the existing "B-3" (General <br />Business) and "R-2" (Two Family) zoning districts to with R-8 (Mobile Home Park) underlying <br />district, a mixed use residential planned unit development (R-PUD) which allows a mix of <br />manufactured housing, traditional housing, and limited seasonal recreational vehicle parking and <br />accessory uses within the property known as the Roseville Mobile Home park. The subject <br />propel1y is located at 2599 Lexington Avenue, and is legally described as follows: <br /> <br />That part of the Northeast Quarter of the Northeast Quarter of Section 10, Township 29, Range <br />23, Ramsey County, Minnesota, described as follows: <br /> <br />Commencing at the southeast comer of said northeast quarter; thence north 0 degrees 59 minutes <br />23 seconds west, assumed bearing, along the east line of said northeast quarter, 1964.41 feet, to <br />its intersection with the easterly extension of the north line of Rose Place as monumented, said <br />point being the point of beginning of the land to be described; thence south 89 degrees 51 <br />minutes 40 seconds west, along said east line 390.37 feet, to its intersection with the southerly <br />line of the Northern Pacific Railway Company right-of-way; thence south 87 degrees 28 minutes <br />37 seconds east, along said south line, 1139.03 feet, to its intersection with the east line of said <br />northeast quarter; thence south 0 degrees 59 minutes 23 seconds east, along said east line, 338.43 <br />feet, to the point of beginning. <br /> <br />The legal description and the corresponding Certificate of Survey are located in Exhibit A. <br /> <br />3.0 Planned Unit Development and Plat Approval <br /> <br />The CITY hereby grants approval of the final development plan for Roseville Estates Mobile Home <br />Park Unit Development, subject to the DEVELOPER's compliance with the tenns and conditions of <br />this agreement. The CITY agrees to approve applications for building pennits, provided that said <br />plans are consistent with the exhibits which were approved at the concept and final stage of the <br />Planned Unit Development process (located in Exhibit B), the DEVELOPER has not defaulted, and <br /> <br />PUD Agreement # 1256 (Raseville Estates Mobile I-lame Park) - I <br />
