MN 55113

Re: Roseville Estates

Dear Dennis:

I am in receipt of the updated.. copies. of,. the PUD Agreement No.
1256. I am comfortable with the language. including the
amendments that you added. However. I would like the following
language inserted at the end of paragraph 9.10. as follows:

The Roseville Estates' emergency shelter located at the
Developer's office, 2599 Lexington Avenue was inspected by a
city building official, fire marshall. and civil defense
director on November , 2002 and. as of such date, the
emergency shelter meets city building and fire code
structural and life safety/access requirements. Therefore,
the emergency shelter is approved by the City of Roseville.

I want this language added before my client signs off on the PUD
Agreement. Obviously, a major component of the arrangement with
the City is that the existing building, when modified as
previously requested by the City. meets city building, fire and
life safety/access requirements. Minn. Stat. ~327.20. Subd. 1(7)
provides that the City must approve the shelter. Therefore, I
want a sentence specifically stating that the Roseville Estates'
shelter is approved by the City. of Roseville.
