<br />3.0 STAFF COMMENT & FINDINGS <br /> <br />3.1 Most of the propertied along County Road C have been granted similar variances, the <br />most recent being approved in 1998 (1404 Talisman Curve). The fence of choice by <br />these neighbors is a solid board on board fence, six feet in height. <br /> <br />3.2 The proposed fence would be setback into the property (north of the evergreen trees) and <br />be located outside the clear view triangle at Sheldon Street and County Road C (see <br />attached). The boulevard area along the north side of County Road Cis 30 feet wide <br />providing adequate sight line distance. <br /> <br />3.3 The location ofthe property adjacent to County Road C and across from a light industrial <br />area and the rail line adversely impacts the privacy of the applicant and his family. <br /> <br />3.4 The character of the parcel (through lot) creates a practical difficulty for the applicant. <br /> <br />3.5 The proposed six foot tall fence will not impact sight lined at the intersection of County <br />Road C and Sheldon Street. <br /> <br />3.6 None of the adjacent properties (this one included) face County Road C; therefore, the <br />fence will not impact front yard views. <br /> <br />3.7 The proposed variance in is harmony with the general purpose and intent of the City's <br />Comprehensive plan and Title 10 (zoning) of the City Code. <br /> <br />3.8 The variance will not adversely affect the public health, safety, or general welfare. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Based on the findings outlined in Section 3 of this report, staff recommends approval of <br />the request for a variance from Section 1012.02b2 of the City Code, to allow an increase <br />in the fence height from four feet to six feet for the front yard of property located at 2655 <br />Sheldon Street. <br /> <br />5.0 SUGGESTED PLANNING COMMISSION ACTION <br /> <br />By motion, recommend to approve (deny) the Thomas Chamberland request for a 2 foot <br />fence height variance for property located at 2655 Sheldon Street based on the findings <br />located in Section 3 of this report. <br /> <br />Attachments: Property location map; site plan indication driveway; and photos of parcel. <br />60-day Time Limit: Application received and accepted on May 25, 2000.
