<br />3.0 STAFF COMMENT & FINDINGS <br /> <br />3.1 Most of the properties along County Road C have been granted similar variances, the <br />most recent being approved in 1998 (1404 Talisman Curve). The fence of choice by <br />these neighbors is a solid board on board fence, 6 to 6-112 feet in height. <br /> <br />3.2 The proposed fence would be setback into the property (north of the evergreen trees) and <br />be located outside the clear view triangle at Sheldon Street and County Road C (see <br />attached). The boulevard area along the north side of County Road C is 30 feet wide <br />providing adequate sight line distance. <br /> <br />3.3 The location of the property adjacent to County Road C and across from a light industrial <br />area and the rail line adversely impacts the privacy of the applicant and his family. <br /> <br />3.4 The character of the parcel (through lot) creates a practical difficulty for the applicant. <br /> <br />3.5 The proposed 6-112 foot tall fence will not impact sight lined at the intersection of <br />County Road C and Sheldon Street. <br /> <br />3.6 None of the adjacent properties (this one included) face County Road C; therefore, the <br />fence will not impact front yard views. <br /> <br />3.7 The proposed variance is in harmony with the general purpose and intent of the City's <br />Comprehensive plan and Title 10 (zoning) of the City Code. <br /> <br />3.8 The variance will not adversely affect the public health, safety, or general welfare. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.0 Based on the findings outlined in Section 3 of this report, staff recommends approval of <br />the request for a variance from Section 1012.02b2 of the City Code, to allow an increase <br />in the fence height from four feet to 6-112 feet for the front yard of property located at <br />2655 Sheldon Street. <br /> <br />5.0 PLANNING COMMISION ACTION <br /> <br />5.1 On Wednesday, June 12, the Roseville Planning Commission held the public hearing <br />regarding the Chamberland variance Request. No citizens were in the audience to <br />address the Commission on this request. The Commission only had questions regarding <br />the location of the proposed fence from County Road C and requested the staff determine <br />the distance and include the distance in the Request for Council Action. <br /> <br />5.2 The Planning Commission voted (7 - 0) to recommend approval of the request by Mr. <br />Thomas Chamberland for a 2-112 foot front yard fence height variance to allow a 6-112 <br />foot tall fence, based on the findings in Section 3 of this project report. <br /> <br />PF3226 - RCA (062700) Page 2 of3 <br />
