The central question is whether a bingo hall is a perniitted use in some or all zoning districts within the City, whether it is allowed only in some, or whether its use is prohibited under the City Code. , -, In reviewing the previous proposal I-advised staff and the Council that, absent an .. . express referenceto the Bingo Hall use in the City's Zoning Code, itwas my'opinion that the activity should be c1assifi~d as an "amusement establishment" under the Code. As a result of this determination, . staff informed the applicant that its proposed , bingo hall/amusement establishment could be located' within a shopping center ' . district upon the issuanc,e of a conditional use permit. The applicant accepted this interpretation and fiied an application for a conditional use permit, however, the - applicant could have appealed the determination to the Planning Commission (for a hearing) and to the Council sitting as the City's Board of AdJustment and Appears. City Code, Provisions As I indicated to Council in my earlier memo; the current City. Code does not contain a use designation for gaIning or gambling activities.'
