<br />Dear Mayor and Members of the City Council:

<br />As you know, we represent Roseville Covenant Church in connection with the
<br />above matter.
<br />
<br />My legal practice for the past 32 years has specialized, in part, in municipal law,
<br />particularly land use and zoning matters. My practice has involved advice to cities and
<br />other governmental bodies as well as representation of landowners and lawsuits involving
<br />land use and zoning matters.
<br />
<br />After reviewing sections of city code, the staff and city attorney reports and other
<br />documents involved in this matter, I have concluded that there are a number of grounds on
<br />which you could deny the application or at a minimum defer action on it and avoid any
<br />serious legal challenge to your action. The grounds are as follows:
<br />
<br />1. The council can interpret the city code to not include gambling facilities as
<br />"amusement establishments". The city staff has suggested that since there is no category
<br />for gambling facilities, the closest possibility in a B2 retail zoning district is the conditional
<br />use known as "amusement establishments". However, the council is free to interpret its
<br />own ordinances and is not required to interpret "amusement establishments" to
<br />
