Plan nine: File 3266: A request by Robert 1. Sladky for variances from the <br />'Shoreland Ordinance to allow construction of a 24 foot 11 inch by 11 foot <br />6 inch (279.68 square foot) four-season porch within the required 75-foot <br />shoreland setback located at 382 North McCarrons Blvd., Roseville. <br /> <br />Roberta Sladky, 382 North McCarrons Boulevard, is requesting variances from <br />Section 1016.22Al, Section 1016.16A, and Section 1004.02D5 of the Roseville <br />City Code to allow the replacement of a 25 foot by 11.5 foot (307 sq. ft.) four- <br />season porch. The variances include: 1) A pre-existing non-conforming lot; 2) a <br />pre-existing non-conforming house within the required 75-foot shoreland setback; <br />3) and a pre-existing structure located within the required side yard setback. <br /> <br />The project report indicated the following findings/recommendations: <br /> <br />The Sladky home was constructed in 1930 as a cabin and includes a detached garage. <br />The home is built on a flat portion of the lot with a rising elevation to the northeast that is <br />mostly held in place by a retaining wall. The lot also slops gently to the lake. The house <br />has been remodeled into a four-season home. Access to the property extends south along <br />a private drive from North McCarrons Boulevard. Sewer and Water serve the house. <br /> <br />The Sladky request has been forwarded to the Department of Natural Resources (DNR) <br />for review and comment. Staff was able to review the request with Mr. Joe Richter of the <br />DNR where the following items were discussed: Mr. Richter indicated the DNR would <br />not oppose the replacement in the exact location. However, he indicated a desire to have <br />the four-season porch reduced (would require smaller size) to lessen the impact of the <br />shoreland setback or the option of reconstruction the porch on the east side of the home. <br />The DNR would like the Sladky's to look into these options, but should they not be <br />appropriate given existing conditions, the DNR would support the variance and porch <br />replacement. <br /> <br />The parcel is odd shaped, has topographical limitations to the northeast and east, is <br />restricted due to a city sewer line and 20 foot wide easement, and has no reasonable <br />alternative. The former four-season porch and its current foundation are pre-existing <br />non-conforming uses. <br /> <br />The City is concerned with how the house is situated on the parcel and the potential of <br />the home lying over the western property line and possibly into the sewer easement. <br />Although the sewer line was constructed many years after the home was constructed, the <br />house and lot are considered pre-existing non-conforming. However, staff considers <br />these two items critical. Should the home lie over the easement created for the sewer <br />line, staff would have to review options to remedy the matter. Further, should the house <br />be located on the adjoining parcel, the Sladky's would be required to seek an easement or <br />acquire property to remedy the matter. <br /> <br />Member Rhody asked whether a smaller porch was considered. <br /> <br />Ms. Sladky said all plans are on hold, pending variance, and using the existing <br />slab has always been the plan. <br />
