Plannine File 3279: A request by the Robert Witt for a variance from the <br />Section 1016 (Shoreland, Wetland, and Stonn Water Management) to the <br />. construction a 1,576 square foot walkout rambler with attached garage on <br />property located at 353 South Owasso Boulevard. The specific variances are: to <br />locate the structure within the required 75 foot shoreland setback; allow a greater <br />impervious area than the required 25%; and a 23 foot variance from Section <br />1004.020 (Minimum Yard Requirements) to allow a pre-existing detached <br />garage to be located in the required front yard. <br /> <br />Chainnan Craig Klausing opened the public hearing and requested City Planner Thomas <br />Paschke to provide a verbal summary of the project report dated January 10, 2001. <br /> <br />Thomas Paschke explained the details of the site development and the history of the site. <br />The structure is not modem and does not meet current Codes. The parcel is six feet lower <br />than the road. There is a shared driveway with the owner to the west. He explained staff <br />findings; the owner did not create the hardship; a new structure can meet the current <br />building Codes; the shoreline setback would be 49 feet which is consistent with adjacent <br />properties; no alternative design could meet existing Codes; there appears to be no health, <br />safety, welfare issues. <br /> <br />Thomas Paschke explained the details of the proposal. Chair Klausing asked for details <br />of the footprint and the safety concerns regarding side yard setbacks (minimum of six <br />feet, up to eight feet). <br /> <br />Member Olson asked for details on the existing garage. The exterior will not match the <br />new home and will increase impervious surface. Th<;>mas Paschke suggested re-siding <br />the structure to match. <br /> <br />Mr. Robert Witt stated the existing garage would be resided. To remove it would require <br />removal of trees. He does propose removal of the boathouse. <br /> <br />Chair Klausing asked for details of the shared driveway. Mr. Witt said a new shared <br />driveway would be constructed. <br /> <br />Member Olson noted that the MnONR asked that trees be placed between the shore and <br />house (five new trees will be planted). <br /> <br />Member Wilke asked the height of the house (I ~ stories). <br /> <br />There were no comments from the public. The hearing was closed. <br /> <br />Motion: Chair Klausing moved, second by Member Olson, to recommend adoption of <br />Resolution #3279 (an executed copy of which is attached), with findings and conditions <br />A through I, as outlined in said Resolution. <br /> <br />Ayes: 5 <br />Nays: 0 <br />Motion carried. <br />
