<br />PLANNING COMMISSION RESOLUTION No. 3279 <br /> <br />A Resolution Recommending Approval of Variances for Robert Witt Allowing the <br />Reconstruction of the Existing Home at 353 South Owasso Boulevard. <br /> <br />WHEREAS, Robert Witt, has requested variances from Sections 1004.02D5 (Dwelling <br />Dimensions and Appearances and Height, Frontage, Yard and Lot Area Requirements in R-l <br />Districts), 1016.16A (Structure Design Standards), 1016.22Al (Non-Conformities), and 1016.26.Bl <br />(Storm Water Management) of the Roseville City Code. The variances include: <br /> <br />A. An existing garage to be less than 30 feet from the front yard property line. <br />B. A structure to be placed less than the required 75-foot shoreland setback. <br />C. A lot to be less that the required 100 foot wide width. <br />D. A greater impervious coverage than the maximum allowed 25%. <br /> <br />WHEREAS, Section 1004.02D5 (Dwelling Dimensions and Appearances and Height, <br />Frontage, Yard and Lot Area Requirements in R-l Districts) requires a front yard setback of 30 feet <br />for the Witt property adjacent to South Owasso Boulevard; and <br /> <br />WHEREAS, Mr. Witt has indicated that he wants to preserve the existing detached garage <br />and convert the structure to a storage building. The existing structure lies 6 to 10 feet (angular) from <br />the front property line and would require a 29 foot variance to keep the structure; and <br /> <br />WHEREAS, Section 1016.22Al (Non-Conformities) stipulates that non-conformities can <br />continue but are subject to applicable State Statutes and City Ordinance regarding alterations, repair <br />after damage, discontinuance of use, and intensification of use, and <br /> <br />WHEREAS, the Witt lot is a pre-existing non-conforming lot with a width of 37 feet along <br />South Owasso Boulevard, an average depth of 172 feet, 51 feet of frontage along Lake Owasso, and <br />a lot size of 8,716 square feet. A buildable pre-existing non-conforming lot of record must meet <br />70% of the lot width and area requirements. The Witt lot does not meet these requirements and <br />would need variances in order to update the existing structure, and <br /> <br />WHEREAS, Section 1016.26Bl (Storm Water Management) requires all single-family lots <br />within the Shoreland Management District to have no more that 25% impervious site coverage. <br />Impervious area includes roof, sidewalk, patio, and driveway areas; and <br /> <br />WHEREAS, the Witt lot is 8,716 square feet in size which allows for an impervious area of <br />2,179 square feet. The existing home, drive, sidewalk, and detached garage has an impervious area <br />of 3,005 square feet or 34.5%. The proposed home, storage building, existing and proposed <br />driveway will have an impervious calculation of 3,305 square feet or 38% and requires a variance to <br />allow redevelopment to occur on the parcel; and <br /> <br />WHEREAS, Section 1016.16 (Structure Design Standards) requires structures to be set back <br />a minimum of 75 feet from the ordinary high watermark (OHW); and <br /> <br />1 <br />
