<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />DATE: {#2/12/01 <br />ITEM NO: I-I <br /> <br />Agenda Section: <br />LAND USE <br /> <br />A request by Robert itt for variances from Sections 1004.02D5 (Dwelling <br />Dimensions and Appearances and Height, Frontage, Yard and Lot Area <br />Requirements in R-1 Districts), 1016.16A (Structure Design Standards), <br />1016.22A1 (Non-Confonnities), and 1016.26.B1 (Stonn Water Management). <br />(PF3279) <br />This request was continued from the January 22 Council meeting due to the absence of the <br />applicant. Since that date, staff has contacted the applicant to explain the need to be present <br />when Council considers action on a request. Mr. Witt apologized for missing the City Council <br />meeting and explained that he was confused on the date of the Council meeting. <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Robert Witt, property owner of 353 South Owasso Boulevard, has requested variances from <br />Section 1004.02D5, 1016.16A, 1016.22Al, and 1016.26Bl of the Roseville City Code to allow <br />the construction a 2,204 square foot full basement rambler with attached garage. The variances <br />include: <br /> <br />A. An existing garage to be less than 30 feet from the front yard property line. <br />B. A structure to be placed less than the required 75-foot shoreland setback. <br />C. A lot to be less that the required 100 foot wide width. <br />D. A greater impervious coverage than the required 25%. <br /> <br />2.0 REVIEW of REQUEST <br /> <br />2.1 Section 1004.02D5 (Dwelling Dimensions and Appearances and Height, Frontage, Yard <br />and Lot Area Requirements in R-l Districts) requires a front yard setback of 30 feet for <br />the Witt property adjacent to South Owasso Boulevard. Mr. Witt has indicated that he <br />wants to keep the existing detached garage and use it as a storage building. The existing <br />structure lies 6 to 10 feet ( angular) from the front property line and requires a 29- foot variance <br />to keep the structure. <br /> <br />2.2 Section 1016.22Al (Non-Conformities) stipulates that non-conformities can continue but <br />are subject to applicable State Statutes and City Ordinance regarding alterations, repair <br />after damage, discontinuance of use, and intensification of use. The Witt lot is a pre- <br />existing non-confonning lot with a width of 37 feet along South Owasso Boulevard, an average <br />depth of 172 feet, 51 feet of frontage along Lake Owasso, and a lot size of 8,716 square feet. A <br />buildable pre-existing non-confonning lot of record must meet 70% of the lot width and area <br />requirements. The Witt lot does not meet these requirements and requires variances in order to <br />update the existing structure. <br /> <br />PF3279 - RCA (021201) Page 1 of 5 <br />
