.-:.~~ STATE OF MINNESOTA POLLUTION CONTROL AGENCY InRe: Indirect Source Permit 97-4 Issued to RYAN TWIN LAKES LIMITED PARTNERSHIP and the CITY OF ROSEVILLE REQUEST TO MODIFY PERMIT SOLELY AS TO OWNERSHIP/CONTROL RYAN TWIN LAKES LIMITED PARTNERSHIP ("Ryan TLLP") hereby requests a modification ofIndirect Source Permit 97-4 (the "Permit"). This request to modify the Permit is solely as to the transfer ofthe ownership and control of the permitted facility from Ryan TLLP to First Security Bank, National Association in its capacity as Owner Trustee under the VS Trust 2000-1 ("FSB"). This request is submitted pursuant to Minnesota Rules part 7001.0190, subpart 2 and General Condition N of the Permit. In support ofthis request, Ryan TLLP states as follows: 1. The Permit was issued to Ryan TLLP (as first permittee) and the City ofRoseville (as second permittee) on May 13, 1997, for the development of the Centre Pointe Business Park on certain real property located in the City ofRoseville, County of Ramsey and State of Minnesota, which is shown on Figure 5A attached hereto (the permitted facility). 2. Ryan TLLP is a limited partnership formed under the laws of the State of Minnesota, with address of c/o Ryan Properties, Inc., 700 International Centre, 900 Second Avenue South, Minneapolis, Minnesota 55402, Attention: Timothy M. Gray, and telephone number of (612)-336-1200. 3. On March 9,2000, and October 3,2000, Ryan TLLP conveyed the property legally described on Exhibit A and shown as the Proposed Offices area on Figure 2 attached hereto (the Veritas Office Campus) to FSB. Until such transfer, Ryan TLLP was the owner of the Veritas Office Campus and operator of the permitted facility. 4. On January 16,2001 FSB delivered to the Minnesota Pollution Control Agency (MPCA) an Update to the Permit for the Veritas Office Campus. 5. This request was prepared by Marie E. McCallum of Ryan Properties, Inc., 700 International Centre, 900 Second Avenue South, Minneapolis, Minnesota 55402, whose telephone number is (612) 336-1223. 6. As of the date of this request to modify the Permit, Ryan TLLP no longer has an interest in any of the property originally covered by the Permit.
