Dear Randi & Brad: Last week the Community Development Department reviewed your submittal for a variance or a setback permit, for the purpose of remodeling and adding on to your home at the intersection (corner lot) of Ryan Avenue and Fairview Avenue. Although in some instances a setback permit is an appropriate process, it does not appear to work to address the issues surrounding your proposal. Specifically, it appears that the attached garage currently lies 10 feet from the property line adjacent to Fairview A venue. Section 1004.02D4 states: "A side yard adjacent to a street on a corner lot shall not be less than 30 feet." Since you would be extending the garage an additional 10 feet toward your side yard property line adjacent to Fairview Avenue, you will be required to obtain a variance. Unfortunately, the application, narrative, and design plans you submitted on January 17, does not meet the submittal requirements necessary to proceed with a public hearing before the Roseville Planning Commission. The submittal must include a current and proposed site plan for staff, Planning Commission, and City Council to consider. The site plans will be used to determine the exact variance distance and any other impacts the proposal may have on other City Code Sections. Your application was also submitted after the deadline passed. However, it is request that you provide the Community Development Department with the necessary site plans on or before noon on Thursday, January 25,2001, to have your request forwarded to the Planning Commission for consideration on February 14,2001. If this date cannot be met, your request will be forwarded to the next appropriate Planning Commission meeting. In summary, your request has been determined to be incomplete and will not be acted upon until such time as the requested information has been provided.
