<br />REQUEST FOR CITY COUNCIL ACTION <br />DATE: 05/14/01 <br />ITEM NO: T-1 <br />Manager ~pproved: Agenda Section: <br />(/I LAND USE <br />Request by Heritage Realty Management, Inc and Border Foods to amend <br />Planned Unit Development Agreement #1199 to increase drive-thru hours of <br />operation for the Taco Bell, 1101 Larpenteur Avenue. (PF3290) <br /> <br /> <br />On March 21, the City Council approved the request for additional sign age for the Taco <br />Bell, but continued the hearing on the extended hours of operation for the drive-thru. <br /> <br />Jim Erickson, Border Foods, was to"meet with the residents who live in Saint Paul, south of <br />Larpenteur, to discuss options for mitigating impacts. Mr. Erickson is to report this <br />information and any proposal to the Council on May 14. <br /> <br />Below, please find the original report presented to the City Council on March 21, 2001 <br />along with the staff and Planning Commission recommendations. <br /> <br />1.0 BACKGROUND <br /> <br />1.1 Heritage Realty, Inc. and Border Foods have requested an amendment to the Roseville <br />Center Planned Unit Development Agreement (#1199) to increase the hours of operation <br />for the drive-thru till 2:00 a.m. every day of the week. <br /> <br />1.2 Border Foods has indicated that they want to remain competitive in the marketplace and <br />desires to increase the drive-thru hours of operation until 2:00 a.m. Hours of operation <br />would not automatically be extended, but would depend on the marketplace, <br />employment, and a cost/benefit analysis. <br /> <br />2.0 HISTORY - HOURS of OPERATION <br /> <br />2.1 The City approved the Roseville Center PUD and Taco Bell developments in March <br />1998. During the consideration of these projects, the Planning Commission supported <br />hours of operation from 9:00 a.m. to 2:00 a.m. determining the impact to adjacent <br />residential properties to be minimal. However, on March 10, 1998 the City Council <br />spent considerable time discussing the hours of operation finally deciding that hours <br />should be limited to midnight on weekdays and 1 :00 a.m. on weekends. As well, the <br />Council specified that Taco Bell's hours of operation should be reviewed in 18 months. <br /> <br />2.2 After 18 month hours of operation, the staff was to review PUD # 1199: <br /> <br />"...Any use on Lot 1, including the proposed restaurant, shall not operate past 12 <br />midnight on Sunday through Thursday or past 1 :00 a.m. on Friday and Saturday. <br />These hours of operation shall be reviewed by the Community Development <br />Director within 18 months of the date a business opens on this site, with a report <br />being submitted to the Planning Commission and the City Council.
