<br />from 11 :00 a.m. to 10:00 p.m., Monday from 11 :00 a.m. to 9:00 p.m., and Sunday from <br />noon to 9:00 p.m.; House of Wong is open Sunday to Saturday from 11:00 a.m. to 9:00 <br />p.m.; and St. Paul Bagelry is open from 6:30 a.m. to 6:00 p.m. Monday through Friday, <br />Saturday 6:30 to 4:00 p.m., and Sunday 7:30 to 3:00 p.m. <br /> <br />3.2 Staff is not opposed to an increase in hours of operation given Taco Bells favorable <br />police and land use record. Staff believes that the labor market and competition in the <br />area dictate whether Taco Bell will stay open until 2:00 a.m. every day of the week. <br /> <br />3.3 Currently Taco Bell closes indoor counter service at 10:00 p.m. and the drive-thru is <br />permitted to stay open until midnight on weeknights and 1 :00 a.m. on weekends. <br /> <br />3.4 In addition to the increased drive-thru hours, staff supports an annual review (for two <br />years) of hours of operation premised on the type of police responses to determine <br />whether the weekday or weekend hours should be reduced. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Staff recommends approval of the PUD Amendment (#1199) allowing Taco Bell to <br />extend the drive-thru hours of operation only from 9:00 a.m. to 2:00 a.m. weekdays and <br />weekends, subject to a review in December of2001 and 2002, to be reviewed by the City <br />Council with appropriate action taken. <br /> <br />5.0 PLANNING COMMISSION CONSIDERA TION/ ACTION <br /> <br />5.1 On February 14,2001, the Roseville Planning Commission held the public hearing <br />regarding Border Foods PUD Amendment request. At this hearing, Peter Anderson <br />indicated his residential neighborhood (California Avenue, St. Paul) is not opposed to the <br />added sign. However, he and his neighbors oppose a weekday expansion of late night <br />hours. Mr. Anderson indicated a concern of increased late night bar traffic in the area <br />where a number of elderly residents and families with children live. <br /> <br />5.2 The Planning Commission asked general questions of staff, Jim Erickson (Border Foods) <br />and Mr. Anderson, for which the received answers (see attached minutes). <br /> <br />5.3 The Planning Commission recommended (5-0) to approve the request by Heritage Realty <br />Management, Inc and Border Foods to amend Planned Unit Development #1199 <br />allowing the increased hours of operation for the drive-thru only until 2:00 a.m. <br />weekdays and weekends for the Taco Bell, 1101 Larpenteur Avenue, with an annual (two <br />year) review in December 2001 and 2002 by the City Council with appropriate action <br />taken. <br /> <br />PF3290 - RCA (051401) Taco Bell PUD Amendment Page 3 of 4 <br />
