While this recodification approach is easier in some respects than adopting
an entirely new ordinance, certain aspects of the current Code may make the process more
difficult. .

We propose to establish a separate billing statement for the zoning code re-write at our
current hourly rate of $115.00 per hour. I propose to serve as the lead attorney for the project
with assistance to be drawn from my partners and associates as necessary.

Our proposed work plan is relatively staff oriented and would involve the Planning
Commission primarily in reviewing permitted conditional and non-permitted uses in existing
zoning districts and in any new zoning districts. In other respects, the Commission and
Council would be asked to review staff and attorney recommendations for changes. We
believe this more limited involvement is warranted given the focus on reorganizing and
clarifying existing provisions in the Code, carrying through on previous Council directions
such as the extension of the Shopping Center 24-hour performance standards to other Business
zones, and amending current ordinance provisions to conform to recent statutory and case law
developments.

I believe we can accomplish these tasks by the end of the year, barring any significant
intervening developments. The number of hours spent on the project by our office should be

Suite 317 · Eagandale Office Center · 1380 Corporate Center Curve · Eagan, MN 55121
