I am <br />enclosing a background article from the American Planning Association regarding this issue. <br /> <br />The City long ago took the most important step in controlling billboards by modifying <br />the City's sign ordinance to prohibit the placement of new billboards within the City. <br /> <br />The City has previously taken the next most effective step in removing existing <br />billboards, that of conditioning new land use permits and approvals on the removal of <br />nonconforming uses, such as billboards. A prime example of this incurred in 1992 when the <br />City conditioned a rezoning and su~division of property at 3104 North Fairview upon the <br />removal of the existing billboard within one year of approval. <br /> <br />Unfortunately, no security was provided to effect compliance with the interim use <br />permit nor was a compliance action undertaken at the expiration of the interim use permit. If <br />you or the Council would like, we can further explore options for seeking to have the Fairview <br />billboard removed. That action would be directed at the current landowner, not the billboard <br />owner and may be an expensive and time-consuming process, so we will not proceed unless <br />directed to do so by Council or staff. <br /> <br />A third method of billboard control has been preempted by the legislature, which in <br />1999 adopted a law providing that except for adult bookstores, theater and similar businesses, a <br />city may not "enact, amend, or enforce an ordinance providing for the elimination or <br /> <br />Suite 317 · Eagandale Office Center · 1380 Corporate Center Curve · Eagan, MN 55121 <br />
