<br />. <br /> <br />. <br /> <br />. <br /> <br />- " <br /> <br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />D <br /> <br /> <br />DATE: 06/26/01 <br />ITEM NO: C-2 <br />Agenda Section: <br />CONSENT <br /> <br />Item Description: <br /> <br />Manager Ap'proved: <br />./1 <br /> <br />A request by Richard Zaun for a six-foot Variance from Section 703.04Bla of the <br />Roseville City Code for property located at 3116 West Owasso Boulevard (PF3296) <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Richard Zaun is requesting a six-foot variance from Section 703.04Bla of the City Code to allow <br />a driveway apron in the public right-of-way to be increased from the required 26-foot maximum <br />width to a width of 32 feet. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Mr. Zaun owns the property located at 3116 West Owasso Boulevard. The property is zoned R-l, <br />Single Family Residential, and the Comprehensive Plan identifies the property as Low Density <br />Residential. <br /> <br />2.2 The City's Pavement Management Program and the reconstruction of West Owasso Boulevard <br />have prompted the variance request. <br /> <br />2.3 <br /> <br />The proposed reduction of this setback will enable Mr. Zaun to retain his driveway in its current <br />location. . <br /> <br />APRON WIDTH <br />Code Re uirement <br />26 feet <br /> <br /> <br />Variance Re uested <br />6 feet <br /> <br />Current Width <br />32 feet <br /> <br />A <br /> <br />3.0 STAFF COMMENT & FINDINGS <br /> <br />3.1 Section 703.04Bla requires a maximum driveway width of26 feet in a public right-of-way. <br />Based on the proposal a variance is necessary to allow the existing driveway to remain. <br /> <br />3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that <br />no practical alternatives exist that would reduce the need for a variance. <br /> <br />3.3 Variances may be granted where the strict enforcement of the literal provisions of the ordinance <br />would cause "undue hardship". The granting of a variance shall only occur when it can be <br />demonstrated that such an action will be in keeping with the spirit and intent of the ordinance. <br /> <br />3.4 <br /> <br />"Undue hardship" as used in connection with the granting a variance means the property in <br />question cannot be put to a reasonable use ifused under conditions allowed by the official <br />controls, the plight of the land owner is due to circumstances unique to the property not created by <br />the land owner, and the variance, if granted, will not alter the essential character ofthe locality. <br />Specifically to this request: <br /> <br />PF3296 - RCA (062601) Page lof2 <br />
