Plannine: File 3296: Zaun request for a six-foot Variance from Section <br />4 703.04Bla for property at 3116 West Owasso Boulevard. <br />5 <br />6 Chair Rhody opened the hearing and requested Thomas Paschke to provide a verbal <br />7 summary of the staff report dated June 12,2001. <br />8 <br />9 Richard Zaun is requesting a six-foot variance from Section 703.04B la of the City <br />10 Code to allow a driveway apron in the public right-of-way to be increased from the <br />11 required 26-foot maximum width to a width of32 feet. <br />12 <br />13 The proposed reduction of this setback requirement will enable Mr. Zaun to retain his <br />14 driveway in its current location. The three findings recommended by the staff <br />15 included: <br />16 <br />17 A. The property in question cannot be put to a reasonable use ifused under conditions <br />18 allowed by the official controls: Mr. laun currently has a 32-foot wide apron that <br />19 provides access to the detached garage (directly adjacent to West Owasso Boulevard) and <br />20 driveway that extends towards the home which provides access and parking. Requiring <br />21 an apron modification consistent with the City Code (26 feet in width) would <br />22 prevent/critically limit access to the home and off-street parking. <br />23 <br />24 B. The plight of the land owner is due to circumstances unique to the property not created <br />25 by the land owner: The City's Pavement Management Program and the reconstruction of <br />26 West Owasso Boulevard has required Mr. laun to apply for a variance ifhe wants the <br />27 existing (or similar) driveway apron width to remain. Mr. laun's driveway <br />28 improvements were constructed prior to the City having a maximum apron width <br />29 requirement for the public right-of-way. <br />30 <br />31 C. The variance, if granted, will not alter the essential character of the locality: The <br />32 proposed six-foot variance to the required apron width in a public right-of-way wiII not <br />33 alter the essential character or the locality, nor adversely affect the public health, safety, <br />34 or general welfare, of the city or adjacent properties. <br />35 <br />36 The staff recommended approval (without conditions). <br />37 <br />38 Member Olson asked about the pre-existing driveway widths to the current City <br />39 Code. <br />40 <br />41 Mr. Zaun said he had no further comment. <br />42 <br />43 Chair Rhody closed the hearing. <br />44 <br />45 Motion: Member Rhody moved, second by Member Duncan, to recommend <br />46 approval of the request by Richard Zaun for a six foot variance to Section 703.04Bla <br />47 ofthe Roseville City Code to allow an increase in the required driveway apron within <br />48 a public right-of-way from 26 feet to 32 feet for property located at 3116 West <br />49 Owasso Boulevard, based on the findings in Section 3 of the project report dated June <br />50 12,2001. <br />
