<br />1 Extract of Minutes of June 12,2001 Draft Planning Commission Minutes: <br />2 <br />3 b. Plannine File 3300: Goodding request for a 10 foot Variance from Section <br />4 703.04Bla for property at 3180 West Owasso Boulevard. <br />5 <br />6 Chair Rhody opened the hearing and requested Thomas Paschke to provide a verbal <br />7 summary of the staff report dated June 12,2001. <br />8 <br />9 John Goodding is requesting a 10-foot variance from Section 703.04Bla of the City <br />10 Code to allow a driveway apron in the public right-of-way to be increased from the <br />11 required 26- foot maximum width to a width of 36 feet. <br />12 <br />13 The proposal would allow Mr. Goodding to retain his driveway. The three findings <br />14 recommended by the staff included: <br />15 <br />16 A. The property in question cannot be put to a reasonable use if used under conditions <br />17 allowed by the official controls: Mr, Zaun currently has a 32-foot wide apron that <br />18 provides access to the detached garage (directly adjacent to West Owasso Boulevard) and <br />19 driveway that extends towards the home which provides access and parking, Requiring <br />20 an apron modification consistent with the City Code (26 feet in width) would <br />21 prevent/critically limit access to the home and off-street parking. <br />22 <br />23 B. The plight of the land owner is due to circumstances unique to the property not created <br />24 by the land owner: The City's Pavement Management Program and the reconstruction of <br />25 West Owasso Boulevard has required Mr. Zaun to apply for a variance ifhe wants the <br />26 existing (or similar) driveway apron width to remain, Mr. Zaun's driveway <br />27 improvements were constructed prior to the City having a maximum apron width <br />28 requirement for the public right-of-way, <br />29 <br />30 C. The variance, ifgranted, will not alter the essential character of the locality: The <br />31 proposed six-foot variance to the required apron width in a public right-of-way will not <br />32 alter the essential character or the locality, nor adversely affect the public health, safety, <br />33 or general welfare, of the city or adjacent properties, <br />34 <br />35 <br />36 The staff recommended approval of the request. <br />37 <br />38 Member Olson asked if a vehicle can be parked in front of the existing garage, <br />39 perpendicular to the street. <br />40 <br />41 Member Wilke asked for details of the replacement materials (similar to present <br />42 materials). <br />43 <br />44 Mr. Goodding had no further comment; Chair Rhody closed the hearing. <br />45 <br />46 Member Wilke asked about details of the hydrant location. <br />47 <br />48 Motion: Member Rhody moved, seconded by Member Traynor, to recommend <br />49 approval ofthe request by John Goodding for a 10 foot variance to Section <br />50 703.04Bla ofthe Roseville City Code to allow an increase in the required driveway <br />
