.

REQUEST FOR CITY COUNCIL ACTION

DATE: 06/26/01
ITEM NO: c- 3

Managerp,IJfoved: Agenda Section:
I) CONSENT
A request by John Goodding for a to-foot Variance from Section 703.04Bta of the
Roseville City Code for property located at 3180 West Owasso Boulevard (PF3300)

t.O

REQUESTED ACTION

2.0

2.1

2.2

.

2.3

1.1

John Goodding is requesting a lO-foot variance from Section 703.04Bla of the City Code to allow
a driveway apron in the public right-of-way to be increased from the required 26-foot maximum
width to a width of 36 feet.

BACKGROUND

Mr. Goodding owns the property located at 3180 West Owasso Boulevard. The property is zoned
R-l, Single Family Residential, and the Comprehensive Plan identifies the property as Low
Density Residential.

The City's Pavement Management Program and the reconstruction of West Owasso Boulevard
have prompted the variance request.

The proposed reduction of this setback will enable Mr. Goodding to retain his driveway in its
current location.

APRON WIDTH
Code Re uirement
26 feet

Current Width
36 feet

A

Variance Re uested
10 feet

3.0 STAFF COMMENT & FINDINGS

3.1 Section 703,04Bla requires a maximum driveway width of26 feet in a public right-of-way.
Based on the proposal a variance is necessary to allow the existing driveway to remain.

3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that
no practical alternatives exist that would reduce the need for a variance.

3.3 Variances may be granted where the strict enforcement of the literal provisions of the ordinance
would cause "undue hardship". The granting of a variance shall only occur when it can be
demonstrated that such an action will be in keeping with the spirit and intent of the ordinance.

3.4

.

"Undue hardship" as used in connection with the granting a variance means the property in
question cannot be put to a reasonable use if used under conditions allowed by the official
controls, the plight of the land owner is due to circumstances unique to the property not created by
the land owner, and the variance, if granted, will not alter the essential character of the locality.
Specifically to this request:

PF3300 RCA (062601) Page lof2
