IPll311l1lll11ll1D12 Wille 3J(I]4!: Overbye request for a 2(1] Jfi!I)(rD~ V 3l1J"D31lID ce iI'!rl!)II1!1l SedmOlDl <br />4 7~3.04JBh for property at 2916 West Owasso Boulevard. <br />5 <br />6 Chair Rhody opened the hearing and requested Thomas Paschke to provide a verbal <br />7 summary of the staff report dated June 12, 2001. <br />8 <br />9 John Overbye is requesting a 20-foot variance trom Section 703.04Bla of the City <br />10 Code to allow a driveway apron in the public right-of-way to be increased trom the <br />11 required 26-foot maximum width to a width of 46 feet. <br />12 <br />13 The proposed reduction ofthis setback will enable Mr. Overbye to retain his <br />14 driveway in approximately its current location. There is need to get around the <br />J 5 garage to the house. <br />16 The three findings recommended by the staff included: <br />17 <br />18 A, The property in question cannot be put to a reasonable use if used under conditions <br />19 allowed by the official controls: Mr. Zaun currently has a 32-foot wide apron that <br />20 provides access to the detached garage (directly adjacent to West Owasso Boulevard) and <br />2 I driveway that extends towards the home which provides access and parking. Requiring <br />22 an apron modification consistent with the City Code (26 feet in width) would <br />23 prevent/critically limit access to the home and off-street parking. <br />24 <br />25 B, The plight of the land owner is due to circumstances unique to the property not created <br />26 by the land owner: The City's Pavement Management Program and the reconstruction of <br />27 West Owasso Boulevard has required Mr. Zaun to apply for a variance ifhe wants the <br />28 existing (or similar) driveway apron width to remain. Mr. Zaun's driveway <br />29 improvements were constructed prior to the City having a maximum apron width <br />30 requirement for the public right-of-way. <br />31 <br />32 C. The variance, if granted, will not alter the essential character of the locality: The <br />33 proposed six-foot variance to the required apron width in a public right-of-way will not <br />34 alter the essential character or the locality, nor adversely affect the public health, safety, <br />35 or general welfare, of the city or adjacent properties. <br />36 <br />37 Staff recommended approval. <br />38 <br />39 Chair Rhody closed the hearing since Mr. Overbye had no additional information. He <br />40 accepted the staff report. <br />41 <br />42 Motion: Member Rhody moved, second by Member Wilke, to recommend approval <br />43 ofthe request by John Overbye for a 20 foot variance to Section 703.04Bla of the <br />44 Roseville City Code to allow an increase in the required driveway apmn with in a <br />45 public right-of-way from 26 feet to 46 feet for property located at 2916 West Owasso <br />46 Boulevard, based on the findings in Section 3 of the project report dated June 12, <br />47 2001. <br />48 <br /> <br />. <br /> <br />. <br /> <br />. <br />
