REQUEST FOR PLANNING COMMISSION ACTION ent Approval: DATE: 06/12/01 ITEM NO: 4c Agenda Section: PUBLIC HEARING A request by John Overbye for a 20-foot Variance from Section 703.04B1a of the Roseville City Code for property located at 2916 West Owasso Boulevard (PF3304) Manager Approved: Item Description: 1.0 REQUESTED ACTION 1.1 John Overbye is requesting a 20-foot variance from Section 703.04Bla of the City Code to allow a driveway apron in the public right-of-way to be increased from the required 26-foot maximum width to a width of 46 feet. 2.0 BACKGROUND 2.1 Mr. Overbye owns the property located at 2916 West Owasso Boulevard. The property is zoned R-l, Single Family Residential, and the Comprehensive Plan identifies the property as Low Density Residential. 2.2 The City's Pavement Management Program and the reconstruction of West Owasso Boulevard have prompted the variance request. 2.3 The proposed reduction of this setback will enable Mr. Overbye to retain his driveway in approximately the same location. APRON WIDTH Code Re uirement 26 feet Current Width 46 feet A Variance Re uested 20 feet 3.0 STAFF COMMENT & FINDINGS 3.1 Section 703.04Bla requires a maximum driveway width of26 feet in a public right-of- way. Based on the proposal a variance is necessary to allow the existing driveway to remam. 3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that no practical alternatives exist that would reduce the need for a variance. 3.3 Variances may be granted where the strict enforcement of the literal provisions of the ordinance would cause "undue hardship". The granting of a variance shall only occur when it can be demonstrated that such an action will be in keeping with the spirit and intent of the ordinance. PF3304 RPCA (061201) Page 1 of2
