<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />DATE: OS/21/01 <br />ITEM NO: 1-3 <br /> <br />Agenda Section: <br />LAND USE <br /> <br />A request by Dennis Prokop to rezone property located at 2108 <br />Haddington Road from R-2, Two Family Residence District to R-3A, <br />Multi-Family Residential District; Three to Twenty Four Units and <br />receive applicable Variances on the property to conform with the new (R- <br />3A) zoning designation (PF3305). <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Dennis Prokop has requested approval of a rezoning from R-2, Two Family Residence <br />District to R-3A, Multiple Family Residential District; Three to Twenty Four Units, and <br />any applicable variances for the property to conform to the new zone. The property is <br />located at 2180 Haddington Road. <br /> <br />1.2 Section 1015.01 to 1015.03 specifies the procedures for considering a property rezoning. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Mr. Prokop recently acquired the property and expressed interest in updating the <br />structure and constructing a detached garage. Staff reviewed the proposal and concluded <br />that the zoning did not conform to the Comprehensive Land Use Plan and a rezoning <br />and/or variances would be necessary to complete work on the site. <br /> <br />2.2 The 16,280 square foot property is currently zoned R-2, ~wo Family Residence District <br />which allows for single family and two family units. The current use of the property as a <br />five unit multiple family residence is a pre-existing non-conforming use within the R-2 <br />zone. <br /> <br />2.3 The City researched the property and concluded that 2180 Haddington Road has been a <br />five unit multiple family residential structure since the 1940's (the zoning code was <br />adopted in 1959). <br /> <br />2.4 Upon completion of its 1997 Comprehensive Land Use Plan, the city had compiled a list <br />of properties whereby the zoning and Comp Plan designations did not match. In the case <br />ofthe subject parcel, located in Planning District 12, the Comprehensive Land Use Plan <br />designation is High Density Residential. The existing land use (designated single family <br />attached) map is a remnant of years past when the owner lived in and rented units within <br />the structure.
