Mr. Marchek's current driveway is located <br />12 12 feet from the property line adjacent to Brenner Avenue and the Code requires a <br />13 setback of 30 feet. <br />14 <br />15 This approval would allow Mr. Marchek to retain the driveway in its current location. <br />16 Mrs. Marchek stated she supported the staff report. <br />17 <br />18 The three findings recommended by the staff included: <br />19 <br />20 D. The property in question cannot be put to a reasonable use if used under conditions <br />21 aI/owed by the official controls: Mr. Zaun currently has a 32-foot wide apron that <br />22 provides access to the detached garage (directly adjacent to West Owasso Boulevard) and <br />23 driveway that extends towards the home which provides access and parking. Requiring <br />24 an apron modification consistent with the City Code (26 feet in width) would . <br />25 prevent/critically limit access to the home and off-street parking. <br />26 <br />27 E. The plight of the land owner is due to circumstances unique to the property not created <br />28 by the land owner: The City's Pavement Management Program and the reconstruction of <br />29 West Owasso Boulevard has required Mr. Zaun to apply for a variance ifhe wants the <br />30 existing (or similar) driveway apron width to remain. Mr. Zaun's driveway <br />31 improvements were constructed prior to the City having a maximum apron width <br />32 requirement for the public right-of-way. <br />33 <br />34 F. The variance, if granted, will not alter the essential character of the locality: The <br />35 proposed six-foot variance to the required apron width in a public right-of-way will not <br />36 alter the essential character or the locality, nor adversely affect the public health, safety, <br />37 or general welfare, of the city or adjacent properties. <br />38 <br />39 Staff recommended approval. <br />40 <br />41 Chair Rhody closed the hearing. <br />42 <br />43 Member Duncan asked if the wall will be constructed by the City along the east <br />44 property line (3.5 feet high and constructed of boulders). <br />45 <br />46 MIotnilJlII1l: Member Rhody moved, second by Member Olson, to recommend approval <br />47 ofthe request by Steven Marchek for a 18 foot variance to Section 703.04B4 of the <br />48 Roseville City Code to decrease the required driveway access point from a comer lot <br />49 property line from 30 feet to 12 feet for property located at 2995 West Owasso . <br />
