REQUEST FOR CITY COUNCIL ACTION

DATE: 06/26/01
ITEM NO: c-~

Manager Approved: t:. IJ Agenda Section:
I IJ CONSENT
A request by Steven Marchek for an 1S-foot Variance from Section 703.04B4 of the
Roseville City Code for property located at 2995 West Owasso Boulevard (PF3306)

1.0 REQUESTED ACTION

1.1 Steven Marchek is requesting an 18-foot variance from Section 703.04B4 of the City Code to
allow a driveway apron (in the public right-of-way) to be within the required setback from a street
comer property line. Mr. Marchek's current driveway is located 12 feet from the property line
adjacent to Brenner Avenue and the Code requires a setback of 30 feet.

2.0 BACKGROUND

2.1 Mr. Marchek owns the property located at 2995 West Owasso Boulevard. The property is zoned
R-l, Single Family Residential, and the Comprehensive Plan identifies the property as Low
Density Residential.

2.2 The City's Pavement Management Program and the reconstruction of West Owasso Boulevard
have prompted the variance request.

2.3 The proposed reduction of this setback will enable Mr. Marchek to retain his driveway in its
current location.

DRIVEWAY SETBACK
CORNER LOT
Code Re uirement
30 feet

Current Setback
12 feet

uest

Variance Re uested
18 feet

3.0 STAFF COMMENT & FINDINGS

3.1 Section 703.04B(4) requires a maximum driveway setback of30 feet from a property line (comer
lot) adjacent to a street right-of-way. Based on the proposal a variance is necessary to allow the
existing driveway to remain.

3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that
no practical alternatives exist that would reduce the need for a variance.

3.3 Variances may be granted where the strict enforcement ofthe literal provisions of the ordinance
would cause "undue hardship", The granting of a variance shall only occur when it can be
demonstrated that such an action will be in keeping with the spirit and intent ofthe ordinance.

PF3306 RCA (062601) Page 1 of2
