<br />REQUEST FOR PLANNING COMMISSION ACTION <br /> <br />Item Description: <br /> <br />DATE: 06/12/01 <br />ITEM NO: 4d <br /> <br />Agenda Section: <br />PUBLIC HEARING <br /> <br />A request by Steven Marchek for an 1S-foot Variance from Section <br />703.04B4 of the Roseville City Code for property located at 2995 West <br />Owasso Boulevard (PF3306) <br /> <br />Manager Approved: <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Steven Marchek is requesting an 18-foot variance from Section 703.04B4 of the City <br />, Code to allow a driveway apron (in the public right-of-way) to be within the required <br />setback from a street comer property line. Mr. Marchek's current driveway is located 12 <br />feet from the property line adjacent to Brenner Avenue and the Code requires a setback <br />of 30 feet. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Mr. Marchek owns the property located at 2995 West Owasso Boulevard. The property <br />is zoned R-l, Single Family Residential, and the Comprehensive Plan identifies the <br />property as Low Density Residential. <br /> <br />2.2 The City's Pavement Management Program and the reconstruction of West Owasso <br />Boulevard have prompted the variance request. <br /> <br />2.3 The proposed reduction of this setback will enable Mr. Goodding to retain his driveway <br />in its current location. <br /> <br />DRIVEWAY SETBACK <br />CORNER LOT <br />Code Re uirement <br />30 feet <br /> <br />Current Setback A <br />12 feet <br /> <br /> <br />uest <br /> <br />Variance Re uested <br />18 feet <br /> <br />3.0 STAFF COMMENT & FINDINGS <br /> <br />3.1 Section 703.04B( 4) requires a maximum driveway setback of 30 feet from a property line <br />(comer lot) adjacent to a street right-of-way. Based on the proposal a variance is <br />necessary to allow the existing driveway to remain. <br /> <br />3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br /> <br />3.3 Variances may be granted where the strict enforcement of the literal provisions of the <br />ordinance would cause "undue hardship". The granting of a variance shall only occur <br />when it can be demonstrated that such an action will be in keeping with the spirit and <br />intent of the ordinance. <br /> <br />PF3306 RPCA (061201) Page 1 of2 <br />
