<br />REQUEST FOR PLANNING COMMISSION ACTION <br /> <br />Item Description: <br /> <br />DATE: 06/12/01 <br />ITEM NO: 4e <br /> <br />Agenda Section: <br />PUBLIC HEARING <br /> <br />A request by John Jackel for a 36-foot Variance from Section 703.04B1a of <br />the Roseville City Code for property located at 3170 West Owasso Boulevard <br />(PF3307) <br /> <br />Manager Approved: <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 John Jackel is requesting a 36-foot variance from Section 703.04Bla of the City Code to <br />allow a driveway apron in the public right-of-way to be increased from the required 26- <br />foot maximum width to a width of 62 feet. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Mr. Jackel owns the property located at 3170 West Owasso Boulevard. The property is <br />zoned R-I, Single Family Residential, and the Comprehensive Plan identifies the <br />property as Low Density Residential. <br /> <br />2.2 The City's Pavement Management Program and the reconstruction of West Owasso <br />Boulevard have prompted the variance request. <br /> <br />2.3 The proposed reduction of this setback will enable Mr. Jackel to retain his driveway in <br />approximately the same location. <br /> <br />APRON WIDTH <br />Code Re uirement <br />26 feet <br /> <br />Current Width <br />62 feet <br /> <br />A <br /> <br /> <br />Variance Re uested <br />36 feet <br /> <br />3.0 STAFF COMMENT & FINDINGS <br /> <br />3.1 Section 703.04Bla requires a maximum driveway width of26 feet in a public right-of- <br />way. Based on the proposal a variance is necessary to allow the existing driveway to <br />remam. <br /> <br />3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br /> <br />3.3 Variances may be granted where the strict enforcement of the literal provisions of the <br />ordinance would cause "undue hardship". The granting of a variance shall only occur <br />when it can be demonstrated that such an action will be in keeping with the spirit and <br />intent of the ordinance. <br /> <br />PF3307 RPCA (061201) Page 1 of2 <br />
