<br />3.9 The Comprehensive Plan encourages reconstruction and upgrading of residential <br />structures (and neighborhoods) throughout the community. Even though this R-l <br />property happens to be a golf course, the upgrading of the current irrigation system will <br />benefit Midland Hills and conserve water usage. <br /> <br />4.0 STAFF RECOMMENDATION TO ESTABLISH FINDINGS <br /> <br />4.1 Staff has reviewed the merits of the three variances necessary to allow Midland Hills <br />Country Club to proceed with constructing the pump house addition and has concluded <br />the following: <br /> <br />A. There are hardships present on or effecting the parcel or the pump house and its <br />addition that warrant granting a variance from Section 1016.17Cla (Permitted <br />Water Oriented Accessory Structures) and Section lOl6.22Al (Non- <br />Conformities); and <br /> <br />B. There are not hardships present on or effecting the property that warrant granting <br />a variance from Section 1010.02 (Exterior Finish); and alternate solutions do <br />exist. Paint peels and ultimately requires maintenance. <br /> <br />C. Staff suggests the Commission use an outline of the following possible findings to <br />determine whether the Commission finds an "undue hardship" significant enough <br />to recommend approval of a variance by the City Council. <br /> <br />1. The hardship situation was not (was) created by the applicant (Midland <br />Hills Country Club) or existed prior to the applicant... <br /> <br />2. The unique physical features or situations within the proposal that could <br />justify a variance include ... <br /> <br />3. The economic issues that may (in part) justify a variance include... <br /> <br />4. The alternative designs that allow use of the site but do not require a <br />variance include... <br /> <br />5. The impacts of the project, ifthe variance was issued, would (would not) <br />create significant community impacts on the health, safety, or general <br />welfare including... <br /> <br />6.
