The application you provided'was reviewed by the Development Review <br />Committees on Tuesday, May 15, and determined to be incomplete. Specifically, you have not <br />provided your determination of "undue hardship" as prescribed below (and indicated on the <br />application):' '" <br /> <br />Variances may be granted where the strict'enforcement of the literal provisions of the <br />ordinance would cause "undue hardship ". The granting of a variance shall only occur <br />when it can be demonstrated that such an action will be in keeping with the spirit and <br />intent of the ordinance. <br /> <br />"Undue hardship"as used in connection with the granting a variaru;e means the <br />property in question cannot be put toa reasonable use if used under conditions allowed <br />by the official controls, the plight of the land owner is due to circumstances unique to the <br />property not created by the ,land owner, and the variance, if granted, will not alter the <br />essential character of the locality. " <br /> <br />Further, a review of your property has revealed other non-conformities to the Code regarding <br />impervious coverage and rear yard area. In the case of impervious area, your lot is 18,106 square <br />feet in size allowiIig 5,432 square of impervious area. Staff has calculated paving and structures <br />to occupy approximately 5,546 square feet, roughly 114 square feet overthe code allowance. In <br />the case of your rear yard area, the Code allows 1,057 square feet of rear yard area for utilization <br />with accessory buildings. Your existing detached gan~ge(I,064 square feet) and the shed (170 <br />square feet) totall,234 squar'e feet which is 177 square feet over the Code allowance. Further, <br />the Code permits accessory buildings to a maximum sizeof864 square feet and allows them by <br />conditional use permit up to 1,008 square feet. A variance is necessary for structures that exceed <br />the 1,008 square foot size limitation. Lastly, accessory building square footage is limited so that <br />it may not exceed the footprint of the live-in portion of the house. In your case, the house has <br />been calculated at 1,140 square feet and the accessory buildings calculated at 1,834 square feet, <br />which is 692 square feet over the Code allowance~ . <br /> <br />2660 Civic Center Drive .:.
