<br />Community Development Department <br />651.490.2279 . fax: 651.490.2931 <br /> <br />May 22, 2001 <br /> <br />John & Laurie Conway <br />1803 Victoria Street <br />Roseville, Minnesota 55113 <br /> <br />RE: Setback Permit Application for new garage. <br /> <br />Dear John & Laurie: <br /> <br />This letter is to inform you that the Development Review Committee (DRC) held its hearing on <br />Thursday, May 17 to consider your request for a Setback Permit to allow a front yard <br />encroachment to a distance 24 feet from your property line adjacent to Victoria Street. While the <br />DRC is supportive of your request and felt that it met many of the conditions necessary for <br />approval, the DRC could not approve the requested setback amount of 24 feet, due to a specific <br />City Code section that regulates lots with non-traditional setbacks. <br /> <br />Section 1004.01E states: Exception: If after May 21, 1959, existing houses on 50% of <br />rnore of the frontage on any block have a predominant front yard different from that <br />herein specified, all buildings hereafter erected shall conform to this predominant front <br />yard depth, provided this regulation shall not be interpreted so as to require a front yard <br />of more than 40 feet in depth. <br /> <br />The house at 1803 Victoria Street was constructed in 19 _ and is setback approximately <br />(City Sight estimate) 36 feet from the front yard property line adjacent to Victoria Street. The <br />Community Development Department has determined that there is no single predominant <br />setback for this block because homes are setback from 36 to 50 feet and in your case the front <br />yard setback is established at 36 feet. <br /> <br />A Setback Permit (Section 1013.05B7) shall not reduce the front or rear yard required setback by <br />more than 20% or be closer than 24 feet to a front or rear property line. In the case of your <br />property, the 20% requirement allows an encroachment of seven feet or to a point 29 feet front <br />the front property line. This would allow you an additional 15 feet to construct a garage given an <br />estimated garage setback of 43 feet from the front property line. <br /> <br />Should you desire to encroach into the required setback further than 15 feet, you will need to <br />apply for a variance from Section 1004.01E of the Roseville City Code. A variance requires the <br />provision of your determination of "undue hardship" as prescribed below: <br />
