<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />Department Approval: <br /> <br />DATE: 06/26/01 <br />ITEM NO: <br /> <br />Agenda Section: <br />CONSENT <br /> <br />A request by John and Laurie Conway for a 14 foot Variance from Section <br />1004.01E of the Roseville City Code for property located at 1803 Victoria <br />Street (PF3311) <br /> <br />Manager Approved: <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 John and Laurie Conway have requested a 14 foot variance from Section 1004.01E of the <br />City Code to allow construction of a 20 foot by 20 foot (400 square foot) attached garage <br />to a within 24 feet ofthe front (Victoria Street) property line. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 The Conway's own property located at 1803 Victoria Street. The property is zoned R-l, <br />Single Family Residential, and the Comprehensive Plan identifies the property as Low <br />Density Residential. <br /> <br />2.2 The City has estimated that the Conway's home is setback 38 feet from the front property <br />line and the existing garage is setback 44 feet from the front property line. It is also <br />estimated that the existing garage lies 65 feet from the road edge of Victoria Street. <br /> <br />2.3 The Conway's applied for a Setback Permit to encroach into the required front yard <br />setback to a distance 24 feet from the front property line. However, the Development <br />Review Committee (DRC) concluded that Section 1004.01E limited a front yard <br />encroachment, due to the homes in this area having a greater front yard setback (36 to 50 <br />feet) than the current 30 foot single family front yard setback requirement. <br /> <br />2.4 The DRC determined that the Conway's predominant front yard setback is 38 feet and <br />recommended that the Conway's receive a Setback Permit to encroach to within 30 feet <br />of the front property line (20% encroachment). <br /> <br />2.5 The Conway's variance is to encroach to within 24 feet ofthe front property line or a 14 <br />foot variance to the required predominant front yard setback (38 feet) as determined by <br />the Community Development Department. <br /> <br />2.6 The following are the Conway's existing and proposed conditions: <br /> <br />Code ReQuirement Current Location <br />38 feet* 44 feet <br /> <br />Applicant ReQuest <br />24 feet <br /> <br />Variance ReQuired <br />14 feet <br /> <br />* <br /> <br />Pre-existing predominant setback. <br />(Section 1004.01E) <br /> <br />PF3311 RCA (062601) Page 1 of 4 <br />
