<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />Department Approval: <br /> <br />DATE: 06/26/01 <br />ITEM NO: <br /> <br />Agenda Section: <br />LAND USE ORD. <br /> <br />A request by Changzhen Gong, PhD, American Academy of Acupuncture an <br />Oriental Medicine, to rezone property located at 1925 County Road B-2 from "I- <br />I", Light Industrial District to "B-3", General Business District (PF3318). <br /> <br />Manager Approved: <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Dr. Changzhen Gong and the American Academy of Acupuncture and Oriental Medicine, <br />(represented by Real Solve, David Gimberline) has requested approval of a rezoning from "I- <br />1", Light Industrial District to "B-3" , General Business District. The property is located at <br />1925 County Road B-2. <br /> <br />1.2 Section 1015.01 to 1015.03 specifies the procedures for considering a property rezoning. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Dr. Changzhen Gong recently gained control of the property and expressed interest in updating <br />the structure for classroom, clinic, and office space for the American Academy of Acupuncture <br />and Oriental Medicine. Staff reviewed the proposal and concluded that the proposed use and <br />zoning did not conform to the Comprehensive Land Use Plan; a rezoning to "B-3" would be <br />necessary to complete work on the site. <br /> <br />2.2 The 16,000 s.f. property is currently zoned I-I, Light Industrial District which allows for offices <br />but not clinic or classroom space. The current use of the property as 16,000 s.f. office (for <br />T.I.E.S.) and approximately 2,000 s.f. of storage was an existing "I-I" conforming use. <br /> <br />2.3 The City researched the property and concluded that 1925 West County Road B-2 was <br />originally built in 1967-68 as part of a complex with the adjoining Windsor Office Plaza at <br />1935 West County Road B-2, which was built later in 1970. The two parcels share parking and <br />access through easement documents. <br /> <br />2.4 Upon completion ofthe 1997 Comprehensive Land Use Plan, the city had compiled a list of <br />properties whereby the zoning and Comprehensive Plan designations did not match. In the <br />case of the subject parcel, located in Planning District 10, the Comprehensive Land Use Plan <br />designation is "B", Business. The zoning is "I -I" and the existing land use is designated <br />office/industrial. The parcel is part of the Tower Place area master plan which stated that a mix <br />of industrial and business/retail uses could occur in the same area, provided they took efforts to <br />provide compatibility in site design, traffic and parking, and pedestrian access. By rezoning to a <br />use compatible within the Comprehensive Plan business designation, the city resolves one more <br />of the Comprehensive Plan to zoning inconsistencies. <br /> <br />PF3318 - RCA (062601) Page 1 of 3 <br />
