<br />6.0 ST AFF RECOMMENDATION <br /> <br />6.1 Staff recommends approval of the request by Dr. Changzhen Gong and the American Academy <br />of Acupuncture and Oriental Medicine, to rezone from I-I to B-3 based on the findings in <br />Section 4 and 5 of this report (06/26/01) and subject to the following conditions: <br /> <br />A. The applicant/property owner agrees to complete an inspection with the fire and <br />building inspector. <br /> <br />B. The applicant/property owner agrees to provide building and life safety code <br />improvement completion plan for approval by the Fire Marshall and the Code <br />Coordinator. <br /> <br />C. Prior to the final approval of the rezoning, the applicant/property owner must provide <br />the Community Development Department with a current legal description attached to an <br />as-built certificate of property survey illustrating all property lines, buildings, paving, <br />and setback dimensions to ascertain that the building meets all B-3 zoning setbacks. <br /> <br />7.0 PLANNING COMMISIONS ACTION <br /> <br />7.1 After holding the public hearing on June 13, 2001, the Planning Commission <br />recommended approval ofthe request by Dr. Changzhen Gong and the American Academy of <br />Acupuncture and Oriental Medicine to rezone from I -I, Light Industrial District to B-3 General <br />Business District for the property located at 1935 West County Road B-2, based on findings in <br />Section 4 and 5 and subject to conditions A through C in Section 6 of project report dated June <br />13,2001. <br /> <br />8.0 SUGGESTED COUNCIL ACTION <br /> <br />By motion, dispense with the first reading of the proposed rezoning ordinance and by second <br />reading, approve of the request by Dr. Changzhen Gong and the American Academy of <br />Acupuncture and Oriental Medicine to rezone from I-I, Light Industrial District to B-3 General <br />Business District for the property located at 1935 West County Road B-2, based on findings in <br />Section 4 and 5 and subject to conditions A through C in Section 6 of project report dated June <br />26,2001. <br /> <br />The draft rezoning ordinance is attached. <br /> <br />Prepared by: Dennis Welsch (651-490-2232) and Thomas Paschke (651-490-2236) <br /> <br />Attachments: Property location map, aerial photo, and proposed development plans. <br />60-day Time Limit: Application accepted on May 07. 2001.
