<br />~ <br /> <br />.' <br /> <br /> <br />June 11,2001 <br /> <br />Mr. Gregg Peterson <br />222 North McCarrons Boulevard <br />Roseville, Minnesota 55113 <br /> <br />RE: Request for a Fence Height Variance. <br /> <br />Dear Mr. Peterson: <br /> <br />This letter is to inform you that the Development Review Committee (DRC) has reviewed your <br />application and attachments regarding your application for a variance to allow construction of a 5 <br />foot 9 inch fence in the front yard of your parcel. The application specifically requests a I foot 9 <br />inch variance from Section I012.02B2 of the Roseville City Code. <br /> <br />The DRC has determined that the application is complete and can be forwarded to the Planning <br />Commission for consideration at their Wednesday, July 1 1,2001. Further notice will be <br />forthcoming regarding this meeting. In the mean time please provide staff with clarification of <br />your address, for which City maps indicate an address of 21 0 North McCarrons boulevard. <br /> <br />Further, please provide Community Development Department with information regarding the <br />parcel's hardships, allowing the City Council to grant the variance. For your information, <br />variances may be granted where the strict enforcement of the literal provisions of the ordinance <br />would cause "undue hardship". The granting of a variance shall only occur when it can be <br />demonstrated that such an action will be in keeping with the spirit and intent of the ordinance. <br /> <br />"Undue hardship" as used in connection with the granting a variance means the property in <br />question cannot be put to a reasonable use if used under conditions allowed by the official <br />controls, the plight of the land owner is due to circumstances unique to the property not created <br />by the land owner, and the vari~nce, if granted, will not alter the essential character of the <br />locality. <br /> <br />In summary, the DRC has accepted your variance application and will forward it to the July II, <br />200 I Planning Commission meeting. However, staff has requested additional variance <br />information and clarification on you address.
