<br />4.5 The proposal seeks the previously supported variance and conditional use permit for a <br />1,008 square foot detached accessory building and an additional variance allowing an <br />accessory structure greater than the rear yard allows and larger than the principal <br />structure. <br /> <br />4.6 The City Code would permit the Boucher's to construct an 832 square feet detached <br />accessory building and a 120 square foot garden shed without any formal consideration <br />or approval. The combined allowable accessory building area is 952 square feet. <br /> <br />4.7 The proposal being sought seeks to eliminate the allowance of a separate garden shed, <br />instead combining it into the size of the detached accessory building. In addition, the <br />Boucher's desire an additional 56 square feet of area to create the 1,008 square foot <br />detached garage size. This proposal requires a conditional use permit and variances from <br />Section 1004.01A3, Detached Accessory Building Size Limit (108 sq. ft.) and <br />1004.01A5, Overall Area (176 sq. ft.). <br /> <br />4.8 Findings for hardship regarding 108 square foot variance to Section 1004.01A3: <br /> <br />A. The property in question camwg be put go a reasonable use ifused under <br />conditions allowed by the official controls: The City staff has determined th.at <br />the property can be put to a reasonable use under the official controls. The <br />Boucher's could construct a detached garage 900 square feet in size and also <br />place a 120 square foot garden shed somewhere in the rear yard. However, i~ is <br />reasonable to allow the combination of the two, limiting the square footage, and <br />restricting the number of accessory structures on the property to one. <br /> <br />B. The pligM of the land owner is due go cirCWlG1lstances IJtmique to the property not <br />created by the lam! owner: Mr. Boucher has lost the use of the storage area ~n <br />which he keeps the trailer and car, along with many of the seasonable items. The <br />Boucher's have a moderately sized lot at a width of 75 feet and a depth of 135 <br />feet (10,125 sq. ft.) that does not support their storage needs. <br /> <br />C. The variance, ifgranted, will not alter the essential dharacter of the locality: <br />The proposed 1008 sq. ft. detached garage would be two feet wider (24 feet) than <br />the existing garage (22 foot) minimizing the mass of the structure from the street <br />view. The structure would be twice as deep (42 feet) as the existing garage (22 <br />foot). The design could be modified through conditions to break-up the mass of <br />the sides facing adjacent properties. Most of the contiguous property owners <br />have signed a petition supporting the Boucher variance and conditional use penrut <br />request. Staff has determined that the proposed garage would not alter the <br />essential character or the locality, nor adversely affect the public health, safety, or <br />general welfare, of the city or adjacent properties. <br /> <br />PF3325 RCA (082701) Page 4 of7 <br />
