<br />.' <br /> <br /> <br />June 11, 2001 <br /> <br />Mr. Fred Boucher <br />166 Laurie Road <br />Roseville, Minnesota 55113 <br /> <br />RE: Request for Conditional Use Permit for an Accessory Structure. <br /> <br />Dear Mr. Boucher: <br /> <br />This letter is to inform you that the Development Review Committee (DRC) has reviewed your <br />application and attachments regarding your application for a conditional use permit to allow <br />construction of a garage addition that would create a 24 foot by 42 foot (1,008 square foot) <br />accessory structure on your premises. <br /> <br />The DRC has determined that the application is incomplete and requires an additional <br />application in order to be processed. Specifically, Section 1004.01A3 (Detached Accessory <br />Building Limit) allow up to 40% of the rear yard to be covered with detached accessory <br />structures. In your case, you have a rear yard area of900 square feet (75 x 30 x 40), which <br />means that in order to process your application you must either reduce the garage to 900 square <br />feet or request a variance and provide the City with the properties hardships. <br /> <br />It is also unclear whether the proposed accessory building is larger than the house footprint, thus <br />requiring a variance from Section 1004.01A5 (Overall Area). Please provide staff with the house <br />size, allow us to determine whether an additional variance is necessary. <br /> <br />For your information, variances may be granted where the strict enforcement of the literal <br />provisions of the ordinance would cause "undue hardship". The granting of a variance shall only <br />occur when it can be demonstrated that such an action will be in keeping with the spirit and <br />intent of the ordinance. <br /> <br />"Undue hardship" as used in connection with the granting a variance means the property in <br />question cannot be put to a reasonable use if used under conditions allowed by the official <br />controls, the plight of the land owner is due to circumstances unique to the property not created <br />by the land owner, and the variance, if granted, will not alter the essential character of the <br />locality . <br /> <br />2660 Civic Center Drive .:.
