.'

June 11, 2001

Mr. Fred Boucher
166 Laurie Road
Roseville, Minnesota 55113

RE: Request for Conditional Use Permit for an Accessory Structure.

Dear Mr. Boucher:

This letter is to inform you that the Development Review Committee (DRC) has reviewed your
application and attachments regarding your application for a conditional use permit to allow
construction of a garage addition that would create a 24 foot by 42 foot (1,008 square foot)
accessory structure on your premises.

The DRC has determined that the application is incomplete and requires an additional
application in order to be processed. Specifically, Section 1004.01A3 (Detached Accessory
Building Limit) allow up to 40% of the rear yard to be covered with detached accessory
structures. In your case, you have a rear yard area of900 square feet (75 x 30 x 40), which
means that in order to process your application you must either reduce the garage to 900 square
feet or request a variance and provide the City with the properties hardships.

It is also unclear whether the proposed accessory building is larger than the house footprint, thus
requiring a variance from Section 1004.01A5 (Overall Area). Please provide staff with the house
size, allow us to determine whether an additional variance is necessary.

For your information, variances may be granted where the strict enforcement of the literal
provisions of the ordinance would cause "undue hardship". The granting of a variance shall only
occur when it can be demonstrated that such an action will be in keeping with the spirit and
intent of the ordinance.

"Undue hardship" as used in connection with the granting a variance means the property in
question cannot be put to a reasonable use if used under conditions allowed by the official
controls, the plight of the land owner is due to circumstances unique to the property not created
by the land owner, and the variance, if granted, will not alter the essential character of the
locality .

2660 Civic Center Drive .:.
