Drive (PF3327). <br /> <br />Manager Approved: <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 This request was continued to the September meeting from July and August <br />meetings. Meeting minutes from July are attached. <br /> <br />1.2 Bauer Homes has requested a variance from Section 1004.02D5 (Setbacks) from the <br />Roseville City Code to allow the demolition and replacement of the existing single <br />family residence structure at 691 Heinel Drive. Bauer Homes proposes to locate the <br />new residential structure 10 feet from the rear yard (east) property line on this corner <br />lot, requiring a 20-foot variance. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 The property located at 691 Heinel Drive is a comer lot with 30 foot required setbacks on <br />the south, east and west sides of the parcel. A lO-foot setback would be applied to the <br />north side of the parcel. <br /> <br />2.2 Using the definition of a lot line "front", the parcel has a front facing west towards Heinel <br />Circle, sides facing south towards Heinel Drive and north towards lake Owasso, and rear <br />towards the east. Specifically the Code reads: Lot Line, Front: That boundary of a lot <br />which abuts a street, and in the case of a corner lot, it shall be the shortest dimension <br />on a public street. Lot Line, Rear: That boundary of a lot which is opposite the front <br />line. <br /> <br />2.3 Bauer Homes owns the lot directly north of the subject parcel and is constructing a <br />specially designed home on the unique parcel. <br /> <br />2.4 Bauer Homes would like to demolish the existing home at 691 Heinel Drive and <br />construct a new structure that fits into a building pad that will allow lake views and is <br />sized to be 30 feet from the north, west and south property lines and 10 feet from the east <br />property line to afford the home a lake view. The current home fronts on Heinel Drive at <br />an angel. <br /> <br />2.5 The City has been aware of recent conflicts with the lot line definition and is in the <br />process of determining a more appropriate way to regulate side and rear property lines for <br />comer lots. However, this modification is part of the overall Zoning Ordinance <br />amendment due later in the year, <br /> <br />PF3327 RPCA (091201) Page 1 <br />
