<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />Item Description: <br /> <br />Date: 07/23/01 <br />Item No: <br /> <br />Agenda Section: <br />CONSENT <br /> <br />City initiated request fo 60-day plan review extension regarding the request by <br />Kathleen Agness (Schorn Realty) for a Comprehensive Land Use Plan Amendment <br />and a Rezoning of property located at 2256 Lexington Avenue (PF3329). <br /> <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 The Community Development Department is seeking an extension to the 60-day plan review time <br />line in order to properly process a land use application that was submitted after the Deadline for <br />July Planning Commission Consideration. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 In May 2001, the Community Development Department became aware of a zoning violation at the <br />former Rymer Academy piano school, 2256 Lexington Avenue. The new occupant, Schorn <br />Realty, purchased the property for use as their finance/realty office. However, this type of use is <br />not permitted in an R-l, Single Family Residence District and does not meet the previous terms <br />and conditions placed on the former Rymer Academy piano school. <br /> <br />2.2 The Community Development Department mailed notice of the zoning violation and requested <br />compliance with the City Code within 30 days (June 21). One option for Schorn Realty was to <br />apply for a comprehensive plan amendment and rezoning. They submitted an application on June <br />21,2001; however, this application was received after the July Planning Commission agenda <br />deadline. <br /> <br />3.0 STAFF RECOMMENDATION <br /> <br />3.1 In order to properly process the application by Kathleen Agness, the Community Development <br />Department is requesting a 60-day plan review extension. The extension will allow the land use <br />application to be processed in August, 2001, without concern over state mandated review <br />deadlines. <br /> <br />4.0 SUGGESTED COUNCIL ACTION <br /> <br />4.1 Adopt a resolution to approve a 60-day extension to the plan review deadline for the request by <br />Kathleen Agness (PF3329) from August 10,2001 to October 9,2001. <br /> <br />Prepared by: Thomas Paschke <br /> <br />Attachments: Resolution. 60-Day Schedule: Application accepted on June 21,2001.
