<br />Comprehensive Land Use Plan Amendment Application <br />2256 Lexington Ave N <br /> <br />#9 The applicants intend to use the property as the offices for their real estate and mortgage <br />company. Both companies are small businesses that have been in Roseville for many years. The <br />use will not require any changes to the property as the property's use for the last 40 years has <br />been commercial. The use will also not adversely affect traffic in the area as there are fewer than <br />20 employees and most client meetings take place outside ofthe office. - <br /> <br /># 1 0 There are no negative changes if rezoning is approved. As the property will maintain it's <br />residential appearance, and will have limited traffic, it should have no effect on property values. <br />There are no health or safety concerns as no chemicals or dangerous products will be used on the <br />premises. Parking will not be affected as there is ample parking already on the property, the <br />backyard was paved by the prior owner. Traffic will actually be reduced given the nature of the <br />proposed business. The two companies have fewer than 20 employee~d in the real estate and <br />mortgage business, most client contact occurs at the clients home, not the office building. We <br />estimate approximately 50 cars per week compared to the 400 cars per wee~ of the prior owner. <br />The reduction in traffic should also make the neighborhood safer. <br /> <br />#11 Low density residential to limited business/office. <br /> <br />#12 Comments were solicited from near by residents and a neighborhood meeting was held on <br />June 20,2001. The area residents were surprised that commercial use was not allowed on the <br />property given the apparent commercial use of the property over the last 40 years. See attached statements from area resl ents. <br /> <br /># 14 The applicant recently purchased the subject property based on representations made by' the <br />property owners and their agent that commercial use was allowe.d Qn..the,proDertv. The <br />representations seemed reasonable as the property had been used for over 40 years as a <br />commercial business. <br /> <br />The fonner property owners operated a business, The Rymer School of Fine Arts Academy, for <br />over 40 years at the property. Over the course of those 40 years many modifications were made <br />to the property to accommodate commercial use. For example, the entire back yard was <br />replaced with a black top parking lot, additions were added to accommodate additional office <br />space, the upstairs bedrooms were sound proofed to accommodate commercial use, and <br />additional entrances were added for individual offices. Given these changes to the property, the <br />highest and best use of the property is for commercial purposes. This is especially true given the <br />location ofthe property. The property is directly adjacent to the on ramp to Highway 36 which <br />significantly detracts from the residential use ofthe property. Real estate appraisers have also <br />indicated that the best use of the subject property is commercial use. See attached letter from <br />Shirley Weidner. The property is very similar to the property north of Highway 36 on Lexington <br />Ave for which the City recentl granted a change to the Co rehensive Land Use Ian We <br />would also mvite the . g CommissIon and/or Council Members to tour the property to see <br />its commercial nature. <br />
