<br />3.2 Roseville Covenant Church has indicated to the City that they want to purchase the <br />property for use as an office and storage (see attachments). This would be a permitted <br />use of the property; however, it requires a variance given the distance the existing <br />structure lies from the adjacent residential lot. <br /> <br />3.3 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br /> <br />3.4 Variances may be granted where the strict enforcement ofthe literal provisions of the <br />ordinance would cause "undue hardship". The granting of a variance shall only occur <br />when it can be demonstrated that such an action will be in keeping with the spirit and <br />intent of the ordinance. <br /> <br />3.5 "Undue hardship" as used in connection with the granting a variance means the property <br />in question cannot be put to a reasonable use if used under conditions allowed by the <br />official controls, the plight of the land owner is due to circumstances unique to the <br />property not created by the land owner, and the variance, if granted, will not alter the <br />essential character of the locality. Specifically to this request: <br /> <br />A. The property in question cannot be put to a reasonable use ifused under <br />conditions allowed by the official controls: Roseville Covenant Church cannot <br />use the duplex for office or storage unless a variance is granted or the structure <br />relocated. Relocating this existing structure to meet a 30-foot separation between <br />structure and adjacent property has been determined to be unreasonable. <br /> <br />B. The plight of the landowner is due to circumstances unique to the property not <br />created by the landowner: Roseville Covenant Church is purchasing the property <br />located at 1380 and 1382 County Road C2 to use as office and storage, which use <br />is permitted, but which use does create a non-conformity. The property is only <br />unique in the sense that it happens to be a pre-existing, non-conforming <br />residential structure set back 7.0 feet from the property line. This does not meet <br />the lO-foot side yard setback for the R-2 residential prescribed setbacks. Neither <br />setback follows the 30-foot church separation requirement. Roseville Covenant <br />Church does not plan to change the character of the existing structure; will require <br />parking of vehicles in the Church parking lot; and require access to the office via <br />the south side of the duplex. (Church signage and parking in the driveway would <br />be allowed.) <br /> <br />C. The variance, if granted, will not alter the essential character of the locality: <br />The proposed 23 foot variance to Section 1004.02A4 will not alter the essential <br />character or the locality, nor adversely affect the public health, safety, or general <br />welfare, of the city or adjacent properties. <br /> <br />PF3333 RCA (082701) Page 2 of3 <br />
