We offer the following <br />comments for your consideration as you make a determination on the need for an Environmental Impact <br />Statement (EIS). <br /> <br />Item 8 - Permits and Approvals Needed <br /> <br />The EA W incorrectly lists the National Pollutant Discharge Elimination System/State Disposal System <br />(NPDES/SDS) General Stormwater Permit for Construction Activity (Permit) for this project as not <br />applicable, Any project that disturbs five or more acres of land is required to obtain a Stormwater Permit. <br />Also, if a project is less than five acres, but is part of a larger common plan of development or sale that is <br />greater than five acres (where multiple separate and distinct construction activities may be taking place at <br />different times on different schedules but under one plan), it is defined as "five or more acres ofland", <br />This means that-this project will need to obtain a NPDES Pennit from this agency. <br /> <br />Item 17 - Water Quality - Surface Water Runoff <br /> <br />The EA W identifies a stormwater pond located just to the south of the site as the pond that will handle the <br />site's runoff. Under other items in the EA W, there is reference to eight ponds that were created in 1985 <br />when initial construction work took place on the site. These ponds were created prior to the issuance of <br />NPDES Stann water Permits for construction activity, which the MPCA started requiring in January of <br />1994. <br /> <br />The Stormwater Permit requires that any project which creates more than one acre of new impervious <br />surface must discharge their storm water runoff into a wet-sedimentation basin prior to discharge into <br />waters of the state, The permit contains design criteria and settling velocity requirements for the ponds, <br />For smaller storm events these requirements can be the controlling factor in the design of the outlet <br />structure so that the pond meets the permit requirements. It is unlikely that the ponds that were created <br />in 1985 will meet these requirements.
