I ( 5 ~ <br /> <br />RE: Centre Point Business Park EA W ' <br /> <br />Dear Mr. Welsch: <br /> <br />The staff of the Minnesota Pollution Control Agency (MPCA) has reviewed the Environmental <br />Assessment Worksheet (EA W) for the proposed Centre Point Business Park. We offer the following <br />comments for your consideration as you make a determination on the need for an Environmental Impact <br />Statement (ElS). <br /> <br />Item 8 - Permits and Approvals Needed <br /> <br />The EA W incorrectly lists the National Pollutant Discharge Elimination System/State Disposal System <br />(NPDES/SDS) General Stormwater Permit for Construction Activity (Permit) for this project as not <br />applicable. Any proj~ct that disturbs five or more acres of land is required 'to obtain ,a Stonnwater Permit. <br />Also, if a project is less'thari five acres, but is part ofa larger common plan of developm.ent or sale that is <br />greater than five acres (where multiple separate and distinct construction activities may be taking place at <br />different times on different schedules but under one plan), it is defined as "five or more aC1.'es ofland". <br />This means that"this project wiU need to obtain a NPDES Pennit from this agency. <br /> <br />Item. 17 - Water Quality - Surface Water Runoff <br /> <br />The EA W identifies a stOnnwater pond located just to the south of the site as the pond that will handle the <br />site's runoff. Under other items in the EA W, there is rcfc:rence to eight ponds that were created in 1985 <br />when initial construction work took place on the site. These ponds were created prior to the issuance of <br />NPDES Stonnwater Permits for construction activity, which the MPCA started requiring in January of <br />4^"'. <br />
