We offer the following comments for your consideration as you make a detennination on the need for an Environmental Impact Statement (EIS). Item 8 - Permits and Approvals Needed The EA W incorrectly lists the National Pollutant Discharge Elimination System/State Disposal System (NPDES/SDS) General Stonnwater Pennit for Construction Activity (Pennit) for this project as not applicable. Any proj,ect that distUrbs five or more acres of hind is required to obtain a Stonnwater Pennit. Also, if a project is less than five acres, but is part ofa larger common plan of development or sale that is greater than five acres (where multiple separate and distinct construction activities may be taking place at different times on different schedules but under one plan), it is defined as "five or more acres of land". This means that-this project will need to obtain a NPDES Pennit from this agency. Item 17 - Water Quality - Surface Water Runoff The EA W identifies a stonnwater pond located just to the south of the site as the pond that will handle the site's runoff. Under other items in the EA W, there is reference to eight ponds that were created in 1985 when initial construction work took place on the site. These ponds were created prior to the issuance of NPDES Stonnwater Pennits for construction activity, which the MPCA started requiring in January of 1994. The Stonnwater Pennit requires that any project which creates more than one acre of new impervious surface must discharge their stonnwater runoff into a wet-sedimentation basin prior to discharge into waters of the state. The pennit contains design criteria and settling velocity requirements for the ponds. For smaller stonn events these requirements can be the controlling factor in the design of the outlet structure so that the pond meets the pennit requirements.
