<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 09/24/01 <br />ITEM NO: C-4 <br /> <br />Department Approval: Manager A~ <br />~1? ~. <br />Item Description: 1\ request by Darlene Erickson & Scott Nelson for a Minor Subdivision <br />(Correction) to modify the existing property line between 2185 and 2175 North <br />Oxford Street (PF3344). <br /> <br />Agenda Section: <br />CONSENT <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Ms. Darlene Erickson and Mr. Scott Nelson, property owners at 2185 and 2175 North <br />Oxford Street respectively, have requested the City Council approval of a "Correction" <br />between two legal conforming lots in Roseville. <br /> <br />1.2 Section l104.04D specifies the procedures for consideration and approval of a <br />"Correction." Specifically, this section of the City Code states: "Corrections: When a <br />survey or description of a parcel or lot has been found to be inadequate to describe the <br />actual boundaries, approval of a corrective subdivision may be requested. This type of <br />subdivision creates no new lots or streets. The proposed corrective subdivision, in sketch <br />plan form, along with a letter signed by all affected owners agreeing to the new <br />subdivision, shall be submitted to the City Council for approval. No hearing or Planning <br />Commission review is necessary unless the proposal is referred to the Commission by the <br />Community Development Director for clarification. The proposed parcels shall not cause <br />any portion of the existing lots, parcels, or existing buildings to be in violation of this <br />regulation or the zoning code. A certificate of survey illustrating the corrected <br />boundaries shall be required on all parcels. Within thirty (30) days after approval by the <br />City Council, the applicant shall supply the final survey to the Community Development <br />Director and City Manager for review and approval. After completion of the review and <br />approval by the Community Development Director and City Manager, the survey shall be <br />recorded by the applicant with the Ramsey County Recorder within sixty (60) days. <br />Failure to record the subdivision within sixty (60) days shall nullify the approval of the <br />subdivision. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Ms. Erickson owns the property at 2185 North Oxford Street and desires to split off a <br />small portion of the side yard (south). The proposal would create a triangular piece of <br />land 8 feet wide at the street right-of-way and 194 feet deep and totaling 1,067 square <br />feet (see attached). <br /> <br />2.2 A privacy fence was erected a number of years ago near the south property line of 1285 <br />North Oxford Street. This fence separated the two properties and left the odd shaped lot <br />remnant, which has been cared for by Mr. Nelson. <br /> <br />Page 1 of2 <br />
