Oxford St. <br /> <br />The Erickson Family has owned 2185 Oxford St. for over 30 years. <br /> <br />The Nelson's have lived at the 2175 Oxford property since they constructed it in 1989. <br />They have owned the lot it was constructed on since they moved into the adjoining house <br />(1027 W. Co. Rd. B) in 1978. <br /> <br />In the spring of 1990 (after construction of the Nelson's house) the Erickson's <br />constructed a privacy fence extending from the rear lot line to within approximately 30' <br />of Oxford Street. The fence was constructed to the north of the lot line, and there has <br />never been any disagreement over the location of the fence. The fence is located <br />approximately 8' north of the line at the east end, and 3' north of the line at the west end. <br /> <br />At the time the fence was constructed, the Nelson's were given permission by the <br />Erickson's to landscape the south side of the fence as they saw fit. In the ensuing 10 years <br />they have added a small block retaining wall, rock gardens, and shrubbery to the south <br />side of the fence. <br /> <br />What we propose is to subdivide lot 15, splitting off the portion that lies on the south side <br />of the fence, to allow a sale of that parcel to the Nelson's. This new parcel is <br />approximately 900 square feet. The split would legally clarify a lot line that has been <br />comfortably established by practice over the last 10 years. <br /> <br />The change in lot line would not cause problems with side setbacks, since the house on <br />the north side of the line is at least 33' feet from the fence. The property at 2175 Oxford <br />was built 10' from the lot line, and this additional land would leave a more reasonable <br />setback on that side ofthe house. Since the back yard of 2175 is only accessible to <br />vehicles via the area between the fence and the house, this lot split would insure future <br />clear access to the rear of the lot for utility service or emergency vehicles. <br /> <br />The attached photos and survey show the area in question, and provide the legal <br />description of all three parcels. The lot line is obviously nowhere near causing setback <br />problems on the northern parcel, and can only enhance the setback on the southern one. <br />Since the total overall change only amounts to about 2% of the land in question and <br />minimum lot sizes should not come into play, we believe that the intended change should <br />be permissible. <br />
